Bierman, and unanimously approved. <br />V. COMMUNICATIONS: <br />A copy of Mr. Wixted's resignation dated February lst was read. <br />VI. COMMITTEE REPORTS: <br />No items. <br />VII. OLD BUSINESS: <br />1) Review of Kenny King fencing and speaker as required by Planning <br />Commission on January 27; 1987. <br />.. . <br />4 b <br />' <br />.y . <br />? <br />At the last meeting the Building Department.submitted a report whicli <br />stated that the fencing on the south east side of the Kenny King pro- <br />perty was not shielding automobile lights as had been stipulated in the <br />approval on December 9, 1986. Mr. Salisbury, attorney for Kenny King, <br />advised that he and Mr. Campbell, president of the corporation, had <br />been on the Schmitz property and viewed the situation. He explained <br />that the fence had originally been a board on board fence, but since <br />this had not been satisfactory, they had.added boards on one side of <br />the fence (between the trash enclos ure to the rear of the adjacent <br />Ha7.leen b uilding) to make a solid fence on one side. Since this is <br />still allowing Iight-to come through, they are now proposing that they <br />will add boards on the other side of the fence so that the fence will <br />be solid on both sYdes, clarifying that they will stagger the boards, <br />',a.'rranging'them over the gaps. Mr. Bierman questioned what they had <br />done about the speakers, since neighbors can hear the Kenny King people <br />taking orders. Mr. Salisb.ury advised that they speaker has been ':turned <br />down to the lowest volume possible. He explained that the speaker and <br />microphone are mounted on a post, and the speaker itself has been <br />tumed within the post, thus being directed into the car. In case this <br />does not work, Councilman Tallon, questioned if it would be possible <br />to turn the post so that the speaker:is directed toward the earth <br />mound. Mr. Salisb ury believes this could cause prob lems. Mr. Gorris <br />is concerned that the fence might not be stable, suggesting that boards <br />could be staggered in such a way as to permit air to circulate. Proposal <br />was explained to Mr. and Mrs. Schmitz, Mrs. Beck and Mrs: Mahoney, <br />neighbors; who still tiave concerns: Mrs. Schmitz: reminded the Commission <br />that originally there were..to be two fences, one on the Halleen property <br />line and one on the Kenny King line. Councilman Tallong aTso questioned <br />the Halleen fence since it was removed during the construction of Kenny <br />Kings. Mr. Salisbury is not sure what happened to the Halleen fence, <br />does not believe that this was the portion of the fence that they re- <br />moved, but stated that the fence on the retaining wall did belong to
