CITY OF NORTH OLMSTED PLANNING COMMISSION MINUTES - JULY 14, 1987 I. ROLL CALL: Chairman Burns called the meeting to order at 8:15 p.m. Present: M. Betts, R. Bierman, B. Gorris, J. Thomas, E. Traczyk, and J. Burns Absent: T. Morgan Also Present: Assistant Law Director J. llubelko, City Engineer J. Schaller, and Clerk of Commissions B. Oring. II. REVIEW AND CORRECTION OF MINUTES: Approval of the minutes of June 23, 1987 will be deferred until the next meeting. III. BUILDING DEPARTMENT REQUESTS: (There was no Building Department representative present).. Chairman Burns stated that at the last meeting the Commission had requested that a Building Department representative be present at all Planning Commission meetings since there had been no representative present for three consecutive meetings previously. Because the Commission is a volunteer body, the members must rely on this department to provide input as to the requirement of the codes. He pointed out that the Commission is somewh at informed about the code, b ut in some circumstances, may not know the particulars or.the practical appli- cations of certain segments of the code and is really not familiar with the building code which determines materials., etc. . However, if the Commission- were to decide that the ineeting was not to be held, it would deny these de- velopers their right of proaess and further explained that the Commission is required by Charter to meet twice a month to hear such proposals. It is his opinion that they could go fozward with':the proposals tonight since these proposals probably would be referred to the Architectural Board of Review and would then be returned to the Commission. Mr. Gorris agreed, stating that if there is no Building Department representative present at the next meeting, he would make a motion to dispense with all Building Department requests until there is a representative. The other members concurred. Chairman Burns then quoted a portion of Article III, Section 3, of Planning Commission Rules and Regulations which states that the Administrative Officers, which includes the Building Commissioner, shall foYward their comments and recommendations to the Planning Commission concerning said maps and plans in writing wfthin 10 days of referral. If any or all of the Administrative Officers shall fail to act upon the time allotted, they shall be deemed to have approved said maps or plans. Mr. Burns stated that he is making a motion that this particular section of our rules and regulations, Article III, Section 3, stands as not applicable for the Building Department requests presented to- night, but for tonight's meeting only, explaining that by the absence of a Building Department representative and nothing having been submitted in -' . writing, they have deemed approval of maps and plans.
