r <br />.,,? . <br />PLANNING COMMISSION JULY 14, 1987 PAGE 2 <br />to refer these items during their initial review and at this time these <br />officers must fozward their comments to the Commission within 10 days, and <br />since this is the initial review of the proposals, it would not apply to <br />the items on this agenda; and since these are the rules of the procedure <br />for the Planning Commission, he does not believe that they would grant any <br />rights to the developers in the event they were not complied with. Mr. Burns <br />withdrew the motion. <br />1) Westin Centre, 30276 Lorain Rd. <br />Review of site plan and change of occupancy for phase 2. (Phase 1 <br />approved by Planning Commission January 14, 1986 but never constructed). <br />Mr. Alloway, Jr., representing his father who owns the building and D. <br />Clark, attorney, explained that interior work has been completed; fire <br />escape is being installed; new steps have been constructed; exterior <br />lighting has been installed (2 lights on front door, 1 light over side <br />door, and 2 pole lights); bids are being taken on parking lot improve- <br />ments; and landscaping will be installed. They presented a letter from <br />the former owner, Mr. Bunn, stating that he had operated a business and <br />an office at this location since September of 1956. There are other <br />structures on the property now (not shown on plan) including a partially <br />constructed wood building which was presented to the Planning Commission <br />in .1985 and never completed. Mr. Allow.ay was not sure of the circumstances, <br />but believed that the building was to be used to paint cars, and this use <br />could not be approved for a wood structure. Mr. Alloway does not know <br />what the plans are for this building at present. Assistant Law Director <br />Dubelko believes that the Law Director has ruled tttat if a building <br />permit is not issued within a year after the Planning Commission approval, <br />it negates those approvals and the proposal must go through the process <br />again; stating th at he has prob lems with going ahead with phase 2 when <br />phase-l is not completed, If no permit was issued for phase 1, he be- <br />lieves th at they should present a proposal for the entire development. <br />Mr. Alloway suggested that this proposal should now become phase 1 and <br />they will re,submit plans later for the remainder of the property. The <br />Commiss=on is reluctant to do this since phase 1 is partially constructed. <br />Since the Planning Commission will be on vacation in August, Mr. Burns <br />stated that he would accept these plans as phase 1 of a three phase pro- <br />ject for referral to the.Architectural Board of Review with the condition <br />that the'plans submitted to that Board reflect the three phase proposal. <br />Mr, Thomas is concerned that permits have not been.issued for interior <br />work, Mr. Gorris is concerned because one b uilding is just a shell, and <br />no screening has been installed as required previously, he stated that <br />they axe stopping one phase and starting another. J. Burns moved to <br />refer the Westin Center site plan and change of occupancy to the Architec- <br />tural Board of Review with the understanding that the Architectural Board <br />will be submitted comnlete site plans that include the partial structure <br />tp the rear and what is to become of that partially constructed building <br />and the previously approved landscaping and buffers for that strLCture, <br />and to forward proposal to the Engineering Department, Forester, and <br />Safety, seconded by E. Traczyk. Mr. Burns explained that he is concerned <br />about holding up the project any longer since the exterior work on the <br />house is virtually completed and the parking lot is being bid now and <br />work qn that could start before approvals were given.
