Chairman Burns stated that the parking space count and the <br />walkway were the main. concerns of the Commission and the layout of the <br />parking at the May Company and J. C. Penny's is not that critical. It <br />was clarified that they are requesting to receive their occupancy permit <br />prior to completing the parking adjacent to the mall by the end of October, <br />and to be allowed to delay the other two area for a year. Mr. Morgan <br />stated that he has no problems with the delay since the proposal is still <br />in keep-ing' with the all over plan. Assistant Law Director Dubelko <br />advised that time limits should be granted for each one of the phases and <br />that they Commission should recommend to the Building Official to grant <br />a conditional occupancy permit, thus failure to complete the parking area <br />would negate the occupancy unless the developer returned to the Commission <br />for another extension. Mr. Carlisle responded that, unlike other develop- <br />ments, they-do have sufficient parking; they are committed to. completing <br />the entire parking area, but they do not want all the phases of the whole <br />parking lot tied'into the certificate of occupancy. Mr: Dubelko clarified <br />that there are distinct phases being discussed, not the.whole parking lot, <br />and that definite time limitations should be set for those three phases. <br />Comnission and Mr. Garlisle discussed time limi`tation. It was decided <br />that a 45 day period beyorid the mall opening would be suitable-for the <br />completion.of the.mall expansion phase. Mr. Betts b.elieves that the devel- <br />oper should have the other 2 phases completed earlier than a year, and it <br />was-agreed that Mr. Carisle would return in 6 months to advised the Com- <br />mission of the status of project. J. Burns moved to approve an extension <br />of time to complete the parking plans sulimitted with the Great Northern . <br />Mall expansion to be from a date of the granting of the conditional occu- <br />pancy permit until 45. days thereafter, that the parking lot adjacent to <br />the expansion that is west of a southerly line from the western wall of <br />J.C. Penny!s and to the south of that, the section adjacent to May Companq; <br />and further, the seetion adj acent to May Company and 'that-section adj acerit <br />to J. C. Penny be given an extension of time of 12 months from the date of <br />issuancy of temporary occupany; and that the pedestrian access from the <br />mall to the strip be granted a 45 day delay from the date granting temporary <br />occupancy and with the.condition-that the developer will return in six ' <br />montfis with an undate of their progress, seconded by T. Morgan, and unani- <br />mously anproved. <br />The Commission decided to discuss several items which were mentionedlin the <br />Building Commissioner's report when the Commissioner is present. <br />VII, NEW BUSINESS: <br />No items. <br />VIII. OLD BUSINESS:. <br />The Commission will also discuss with the Building Commi.ssioner exactly what <br />should be included in the plans presented to them. <br />The new Zoning Codes have been-printed and will be discussed after Council <br />passes.legislation to approve the new numbering system. <br />IX.
