BOARD OF ZONING APPEALS MARCH 4, 1987 PAGE 4 <br />was administered to Mr. Thesling, owner, and Ms Parry, from Volkswagen. <br />Chairman Remmel stated that this was not the propos.al that was approved by <br />Planning Commission. Ms Parry stated that when they sent the letter of <br />permission for the restaurant to use their adjacent driveway, they were <br />only granting permission to use their driveway for emergency vehicles, <br />not for patrons of the restaurant. Chairman Remmel stated that it was <br />clear in the Planning Commission minutes that they must remove a section <br />of the building to increase the drive. Mr. Thesling stated that at the <br />time of the Planning Commission meeting they understood that if they wanted <br />approval for the mutual drive, they would have to get permission from the <br />dealership. Law Director Gareau stated that the purpose of the width of <br />the drive is to permit vehicles frequenting the establishment to be able <br />to drive side by side. Mr. Bugala stated that he would not even consider <br />this without a permanent easement. Mr. Thesling stated that when the <br />building was converted to a commercial building in 1980, no one ever <br />mentioned the 18 foot wide drive requirement or they would have included <br />it at that time; and advised that there had always been 10 parking spaces <br />in the rear. Mr. Gareau stated that they are expanding the use, and he <br />is now required to have the wider driveway. Mr. Thesling questioned if <br />he could xeduce the rear parking area, since this is a small restaurant,. <br />and removing 7 feet of the building will be removing approximately 15% of <br />the building and would reduce approximately 25% of the seating. Mr. Remmel <br />stated that the two drives were not even on the same level, and customers <br />would undoubtedly use the adjacent drive. Law Director Gareau stated that <br />if he had a mutual driveway easement or a license to use the driveway, it <br />might be a different situation. Ms Parry advised the Vorelco, owner of <br />the property, would not grant an easement. Mr. Remmel and Mr. Bugala <br />agreed that they should have a legal permanent easement and a license <br />would not be permanent. C. Remmel moved to grant the variance, seconded <br />by R. Bugala. Roll ca11 on motion: Remmel, Bugala, Gomersall, and Helon, <br />no. Motion failed to pass. Variance denied. <br />r- <br />t. -- <br />7. Benita Waghray, 24693 Lorain Rd. <br />Request special permi,t to add to and renovate existing nonconforming building <br />(front set b ack). Special permission required by Ord. 62-33, Section 1231.02. <br />Chairman Retnmel called all interested parties before the Board. The oath <br />was administered to Dr. S. Waghray and Dr. Waghray who explained that the <br />front porch will be taken off, building will be upgraded, a small addition <br />will be built on the rear and the entire rear area will be cleaned up. <br />There is an existing chain link fence on the property. The Board agreed <br />this would be an improvement. C. Remmel moved to grant the special permit <br />to add to and renovate the existing non-conforming building at 24693 Lorai.n <br />Road, seconded by J. Helon, and unanimously approved. Special permit granted. <br />8. MC Sporting Goods, 5106 Great Northern Shopping Center, Plaza South <br />Request heard above. <br />9. S. Strang and C. Gronbech dba Caron Properties, 23755 Lorain Road <br />Request special permit to renovate and add to non-conforming building (front <br />set back). Special permission required by Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board.
