The oath was <br />administered to Mr. Papatto, owner of Suburban Auto Bodye Chairman Remmel <br />read a letter from the Mill Garden Condominium Qwners Association objecting <br />to more cars being parked in front of the abandoned house on Mill Road and <br />requesting that the Board reject anv request for a variance or a temporary <br />variance on this property pointing out that the business has been cited <br />several times. Mr. Papatto explained that he had purchased the propertv <br />in the.: fall in order to alleviate the stacking of cars waiting to be repaired <br />on his adjacent property on Dover Center Road and that he will have the house <br />removed and the land paved for a parking lot as soon as the weather permits. <br />He further stated that he had tried for sometime to purchase additional pro- <br />perty but had been unsuccessful; he did not buy the property only beeause <br />he was eited by the City, but because his business was growing so rapidly. <br />Law Director Gareau questioned why the house could not be removed now and <br />slag put on the surface until Daving can be done; and suggested that an <br />eight foot fence be installed so these damaged cars can be obscured behind <br />the fence. Since these plans must go to the Planning Commission for approval, <br />Chairman Reummel believes that the fence issue should be decided by them. <br />Mr. Graee agreed with Mr. Papatto that it would be almost impossible to <br />demolish the house and grade the property at this time of year and paving <br />cannot be done until the asphalt plants open sometime in Aprilo He believes <br />that the problem.could'be solved within a few months if a temporary variance <br />were granted prior to the hearing by Planning Commission. Mr. Gareau advised <br />that .the two lots must be assembled through.Planning Commission as well as <br />having the plans approved; and suggested th at the variance should be permitted <br />during construction but.that some time limits should be set, and if the owner <br />does not comply with the conditions of the variance with the time limit speci- <br />fied, he would go to court with an injunction. Mro Bugala is reluctant to <br />grant any variance for storing the cars in the set back area but would be <br />agreeable if they are set back 10 feet from the sidewalk. Councilman Tallon <br />advised that he had received many complaints about this property and that the <br />owner has ignored previous citations issued b_y the City for both the cars and <br />the junk and debris on the premises, stating that he did not see the need <br />for this variance. Mr. Papatto responded that he had removed the debris which <br />had been left by the previous owner and that he had been unable to purchase <br />any additional property until just recently. He was advised not to place <br />any more cars on the property until his paving is completed. R. Grace moved <br />to grant a temporary variance to Angelo Papatto, Suburban Auto Body, with the <br />condition that he apply to Planning Commission within the next thirty days <br />and that if he fails to do so he will be cited by the City or the Law Director <br />will pursue an injunction, and we will give him no longer than June lst to <br />couplete the project, that all cars must be set back 10 feet from the sidewalk <br />on Mill Road and parked single file during this temporary variance; and should <br />the Planning Commi.ssion reject this application the variance is voided, <br />seconded by R. Bugala, and unanimously approved. Councilman Wilamosky wants <br />it clarified that this is a temporary variance until June lst and if the pro- <br />ject is not comp-leted by June 2nd the temporary variance is recinded. The <br />clerk was advised that.if Mr. Papatto applies for Planning Commission within <br />satisfy the condition of the variance. , ;4 <br />30 days in order to be on the agenda of the Marcla lOth meeting, that will <br />
