They explained that these <br />are large dogs, and since children cut through their property, they are con- <br />cerned that the dogs couldJump a 5 foot fence; the higher fence could also <br />keep the children from climbing it. Several members have concerns since <br />these dog runs have caused previous problems. Mr. Grace pointed out that <br />this one is not right on the property line and he is concerned about the <br />safety of the children. B. Grace moved to grant the 1 foot height variance <br />. for a dog run for RoseMarie and Edward Doehring, 27880 North Park Dr, at <br />" the location that is shown on the plan, seconded by R. Gomersall. Roll call <br />on motion: Grace arid Gomersall, yes. Bugala, Helon, and Remmel,.no. Motion <br />failed to pass. Variance denied, <br />14. Carriage Plaza, 25151 Lorain Road <br />Request for variance (1133.13). Request variance for location of Z.truck <br />loading zones (encroaching into 50 foot buffer area adjacent to residential <br />nroperty). Violation of Ord. 62-33, Section 1214.02. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Kovacic, the owner, Mr. Acciarri, architect, Mr. Valore, <br />attorney, and Councilman McKay. Mr. Remmel advised that the Planning Commis- <br />sion had recommended the variance be granted for these truclc loading zones <br />which are existing. Law Director Gareau advised that the truck loading areas <br />are not permitted in the 50 foot set back adjacent to residential propert_y. <br />Mr. Valore explained that the original building had been there for 16 years, <br />and the second building was apnroved three _years ago, with the loading zones <br />shown where they are now located. There is no change to what is existing, <br />it has been used this way. Building Commissioner Conway explained that <br />the truck loading zone for a new phase of this building conforms to code and <br />would be large enough to service the entire plaza, but its location would <br />not be convenient to the older portion of the building. Law Director Gareau <br />advised that there is a noise ordinance which allows loading and unloading <br />only at certain times. R. Bugala moved to grant the variance for the location <br />of two truck load zones (encroaching into the 50 foot buffer area adjacent to <br />residentail property) for Carriage Plaza, 25151 Lorain Road, seconded by <br />B. Grace, and unanimously approved. Variance granted. <br />15. David and Elaine Balfe, 24334 Elm Road <br />Request for variance (1133.13). Request 10 foot variance for distance between <br />house and proposed detached garage. Violation of Ord. 62-33, Section 1151.04-C. <br />Also request 3 foot side yard variance for garage. Violation of Ord. 62-33, <br />Section 1151.04-C. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. & Mrs. Balfe who explained that they placed the garage <br />at this location in order to save a tree. Mr. Remmel stated that the garage <br />could be placed back further, facing the street. Mr. Balfe stated that it <br />would then block their view of the back yard. Building Commissioner Conway <br />stated that if they encroach into the 20 foot set back, he would like the <br />wall of the garage closest to the house fire rated. Board discussed several <br />alternative positions for the garage and it was decided that a smaller, <br />20 foot by 24 foot garage could be built with a 6 foot variance for the distance <br />between the house and garage; but the members agreed that the side yard vari- <br />ance is not acceutable. B. Bugala moved to grant a 6 foot set back variance <br />for the distance from the house to the garage and that the wall of the house <br />abutting the rear of the home be fire proofed, but they must meet code <br />t:
