<br />PLANNING COPW-ISSION APRIL 26, 1988 PAGE 3` <br />1) Hennie Homes Lot Split and Consolidation Plan <br />The uronosal i:s to split off the southerly strip of sublot no. 39 of <br />the Pheasants Walk Subdivision and join it to permanent parcel no. 233-25-5 which abuts on the east. The location is the north side of <br />Lorain Road between Wellesley Avenue and Stearns Road. Note that nro- <br />posed sublot "B" zoned Retail Business, General, does not conform to the <br />Zoning Code req_uirement of 150 feet frontage at the right-of-way line. <br />Continued from the Planning Commission meeting of April 12, 1988. <br />City Engineer Boyer advised that the sublots which were partially zoned . <br />General Retail had been rezoned to residential in 1985. This 20 foot <br />strip of land is one of four that were left on either side of the two <br />roadways into the subdivision, and the subdivision was approved with the <br />condition that these strips must be deeded to the adjoining vroperty <br />oumer5. NIr. Welke, renresenting Hennie Homes,:explained thisis the <br />first strip to be split off, and they have not come to an agreement with <br />the other property owners. Mr. Boyer explained that the PBM proverty <br />which is acouiring this land is non-conforming now, and will be less <br />non conforming after the assembly. Commission has no problem with this <br />assembly. B..Gorris moved to approve the spliting off of the so,utherly <br />striu.of sublot no. 39 of the Pheasants Walk Subdivision said sub.lot <br />being 20 foot in width and joining this uiece to nermanent narcel <br />233-25-5 which abuts this parcel on the east, seconded b_y R. Bierman, <br />and unanimously apnroved. , <br />2) Canterbury Road (southerly port3on) Vacation Plat <br />The pronosal (by petition) is to vacate the southerly portion of <br />Canterbury Road, as recorded in Volume 124, page 14 of Cuyahoga County <br />Map Records, and which ab uts sublots 32 through 39 of the Pebblebrook <br />Subdivision (recorded in Volume 239, page 34 of CCMR), and continues <br />south to the North Olmsted Corporation Line, as shown on the vacation <br />plat. . <br />N. Breenan, Sunrise Land.Company, explained that this roadway was dedicated <br />and accepted•by the City in the 1920`s;but"no improvements:were installed <br />and no financial arrangements were made, a:condition that would no longer <br />be uossible in the City. This street will not benefit the adjacent <br />property owners (the property owners in the Pebblebrook Subdivision would <br />abut this property to.the rear and a golf course abuts on the other side. <br />The street is not dedicated in Olmsted Township iahere it would continue. <br />At the time the subdivision was approved, there was discussion of vacating <br />the street, but it was. never acted i1DOI1. This property will be given to <br />the abutting-property owners. Councilman ?KCKay stated that if the lots <br />are larger,larger homes can be built and the City will realize additional <br />tax mone_y. Mr. NTorgan is concerned that eliminating the street could. <br />prevent any future development of the oolf course. Mr. Bierman is con- <br />cerned,that this could cause a lia3ility for the city, since the residential <br />lots will be abutting a golf course. Mr. Scheef, Springvale Country Club, <br />does not believe that there would be a problem in this area since the. <br />property is heavily wooded and, even if the street remains, it would never <br />be app.roved by the City since it would be adjacent to the rear property <br />lines. He maintains that if the go-lf course was developed, a street <br />would have to be installed at another location.
