Mr. Kiczek, who lives across Columbia Road, maintains <br />that after the original owner died subsequent owners have mainly been <br />interested in making a profit from this house. He advised that one <br />owner, Elaine Hall, had an engineering report on the property which <br />whowed that the earth below the house was breaking away. He is concerned <br />that if the existing trees are removed it will harm the adjacent Ojeman's <br />property. Mr. Morgan again stated that the owners legally have the <br />right to split the property, but the Engineering Department can make <br />certain requirements prior to obtaining a building permit. J. Thomas <br />moved to approve the proposal to subdivide permanent parcel number <br />237-30-5 into two (2) sublots located on the east side of Columbia Road, <br />south of Cedar Point Road, the Gustafson Lot Split, with the recommen- <br />dations that : 1) the Engineering Department do a search of the files <br />on that property to determine whether an engineering report was filed <br />with the city indicating any stress on that property under the home or <br />any of the adjacent property where disturbances or where building could <br />have an adverse_impact on that property or on adjacent property owners; <br />2) the Building Commissioner take special note of the property and the <br />condition of the property if, in fact, after this lot split the property <br />owner requests any kind of permits for building that the Building De- <br />partment take special note of the enviornmental impact of building on <br />the property and whether or not the property is capable of withstanding <br />developments 3) we recommend that if there is any development proposed <br />for the property that soil borings be done and that engineering studies <br />be made on the drainage to determine whether ormot the property can <br />support development; and 4) request that the Building Commissioner <br />advise the Commission on an informal basis if any permit has been'-re- quested, seconded by R. COr?IUNICATIONS: <br /> <br />Ord: 88-75: An Ordinance creating New Chapter 1141 of the North Olmsted <br />Zoning Code, entitled "Office Building District." <br />Commission has discussed'this in committee and will be forwarding several <br />suggestions to the BZD Committee. Mr, Skoulis, president of the Park West <br />Home Owne.rs Association, advised the Commission that they are discussino <br />a proposal to rezone land adjacent to their subdivison te this classifica- <br />tion with the developer; and they beleive there should be some modifications <br />to the ordinance. In response to his questions, Assistant Law Director <br />Dubelko clarified that the minimum lot width of 200 feet is required in <br />this district with the possible exception that if an existing lot with less <br />than the required frontage was rezoned to this classification it could be <br />grandfathered in, but it is to be assumed that the city would only rezone <br />conforming lots. Mr. Morgan explained the Commission's recommendations to <br />Mr. Skoulis who was satisfied with most points but believes that landscaped <br />buffer requirements and lighting restrictions are not specific enough. <br />He was.advised that the Planning Commission.must approve.both buffers and <br />lighting and that residents'concerns are always taken into consideratiori. <br />It was pointed out by Mrs. Dive'r, a member of the audience, that Section <br />1141.07 would have to be changed to 50 feet, since Section 1141.07C is <br />to be modified.
