Chairman Morgan advised the residents how Ordinance 88-75 would proceed and explained that they could still-make suggestions. Regarding the rezoning request, P1r. Morgan does have concerns about rezoning lots which are not owned by the developer, thus creating non-conforming lots; unless they are acquired and assembled by the developer and pointed out that any approval of this rezoning would have to be contingent upon the approval of Ordinance 88-75, and conditioned upon access being limited to Brookpark Road. Mr. Gorris agreed and pointed out that if the property were to be developed as zoned, a multi-family development would be allowed to use the residential streets; if it cannot be developed as zoned, this land could be rezoned through the courts; and noted that the developer was willing to rezone without the set back.s being determined; and is willing to work with the neighbors re- garding buffers, screening etc. T. i•lorgan moved to approve the rezoning of that land which is requested from Residence,.P4ultiple District to Office Building District and that parcel of land that is requested for rezoning from "C" Residence Single District to Office Building District excluding those_parcels of land that front Columbia Road and with the restriction that entrance and egress to this parcel will only be from Brookpark Road and contingent upon approval of Ord. 88-75 and also contingent upon assembly of these parcels into one plat that will meet with the requirements of Ord. 88-75, seconded by E. Traczyk. Roll call on motion: Morgan, Traczyk, Betts, Bierman, Bowen, and Gorris, yes. Mr. Thomas, no. Motion carried. Member of the audience were advised that Ord. 88-75 would be discussed at the next Planning Commission meeting and that copies of that ordinance can be obtained from Councilma.n McKay. V. COMMiJNICATIONS : Letter from County Commissioners will be discussed at the next meeting. Invitation f or. America`s Planning Association meeting VI. COMMITTEE REPORTS: Mr. Gorris was elected chairman of the Planning Review Committee which is workirig with Mr. Hill, the City Planner. 1!1r. Hill will forward his comments to the Clerk of Council who will send them on to the members of the committee. The committee members must respond within ten days to Mr. Gorris who will compile this information for Mr. Hill. Meeting will be called at the descretion of of the chairman on the thrid Wednesday of the month. The Clerk of Council will forward copies of the minutes to the C1erk of Commission who will send them to Commission members. VII. NEW BUSINESS: No items. VIII. OLD BUSINESS: Ord. 88-75 will be discussed at the next meeting Mr. Boyer advised that Traff-Pro study is being revised and will be sent to members. IX.
