l <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - FEBRUARY 3, 1988 <br />Chairman Remmel called-the meeting to order at 7:30 p.m. <br />Present: R. Bugala, B. Grace, J. Helon, and C. Remmel <br />Absent: R. Gomersall <br />Also Present: Law.Director M. Gareau, Building Commissioner Conway, and <br />Clerk of Commissions B. Oring. <br />B. Grace moved to approve the mi.nutes of January 6, 1988, seconded by R. <br />Bugala, and unanimously approved. <br />1. C. and V. Beck, 3920 Walter Rd. <br />Request for variance (1123.12). Request 6 foot 2 inch front set back vari- <br />ance to add attached garage.(existing attached garage to be converted to <br />living area). Violation of Ord. 87-93, Section 1135.06-(a). Chairma.n Remmel called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Beck and neighbor; Mrs. Scherbon. Mr. Remmel <br />stated that the house to the north extends out 15 feet and the one to the south <br />extends out about 5 feet from the Becks existing garagee Proposal was explained <br />to Mrs. Scherbon who is concerned because garage will be in front of her.garage. <br />It was clarified that they would only be encroachirig 6 feet 2 inches into the <br />front set back. Board agreed that this is an improvement and otfier homes in <br />the neighborhood are at 3rregular set backs. C. Remmel.`moved to grant:the <br />6 foot 2 inch frorit set back variance to add an attached garage at 3920 Walter <br />Road for C. and V. Beck, seconded liy B. Grace, and unanimously approved. <br />Variance granted. 2. Suburban Auto_ Body and Frame -Co, 4960 -Dover Center Rd. ' <br />Request for variance (1123.12).- Request variance to place fence in front set <br />back to screen parking area:, Violation of Ord: 87=93, Section 1139.04(a). <br />Chairman Remmel called all interested paxties before the Board. The oath was <br />administered Mr. Pappato, 'the owner, Mr. Giesser, his attorney, and residents <br />of the Mill Garderi':Condominiums, Mrsa Brezina and Mrso Wood. Mr. Giesser <br />explained that originally they were required by the city to place the fence <br />at the 50 foot front set back line (fence was to be staggered with an opening <br />in the middle), at this time they are requestiiig a variance to-place the f.ence <br />immdediately liehind the landscape area in order to have a larger area in which <br />to store damaged vehicles. He pointed out that the Law Department had deter- <br />mined that Mill Road was not a side street.(property is on a corner), so a <br />50 foot set back was required. Chairman Remmel read the minutes of February <br />4, 1987 at which time a temporary variance was granted to store-cars'in-`the <br />front set back until house could be moved and property-paved,-with the stipu- <br />lations'that the pronosal would be'forwarded to Planning Commission and that <br />work would be completed by.June lst. Mr. Pappato stated that .the lot is paved; <br />and landscaping installed (landscaping was delayed because of the contractor), <br />and that he has been working with the Building Department, but he does not <br />believe that that the fence as proposed is workable since tow trucks and <br />flat bed trucks. could not manuever between the sections of fence, and he <br />needs more room to store damaged cars. Councilman Tallon 'objects to placing a structure in the 50 foot set back since Mill Road is zoned General Retail
