Law Director Gareau <br />advised that the urevious temporarv variance was to park in the front set <br />back until the house could be removed and the paving completed, the fence <br />was not nart of that variance. Councilmen Bohlman and jdilamosky were sworn <br />in at this time. Councilman Bohlman stated that the BZD Committee h ad <br />stinulated that the fence be installed at the 50 foot line. Councilman <br />Wilamoskv urged the Board to reject the request since it would infringe <br />on the building and set back line. Mr. Pannato listed the improvements that <br />he has made on his property in the last year without being asked to and <br />believes that he is being singled out by the city. Mr. Bugala believes <br />that his business has expanded- beyoncl the limits of his property. Mr. Gareau <br />believes that the neighbors would be better off if the fenc&,was:moved <br />forwaxd somewhat (not as far foZward as proposed) and suggested putting it <br />at a 25 foot set baelc. Mr. Tallon stated that even if the fence placed <br />closer, there would still be overflow storage on the Dover Center side of <br />his pronerty. Mr. Gareau st.at;ed:th•lt Council must address. all body shops <br />in the city, pointing out that others store damaged vehicles in the front <br />set-back. Mr.. Remmel suggested eliminating the garage in the back of <br />the property so more narking could be added. Mr. Pappato stated that <br />he used this building f.or storage. After some discussion, it was agreed <br />that a 6 foot wolmanized wood fence with a gate could be installed at the <br />25 foot set back.. Mr: Pappato advised that Board that the car rental <br />agency mentioned.on his-si:gn was only two cars which he rented to customers <br />whose cars were being repaired arid those cars.were always in use and not <br />stored on the nroperty. Councilman Wilamosky requested.that if the.variance <br />is-granted, the Board stipulate that the gate is to be kept.closed except <br />excent for immediate ingress/egress. C. Remmel moved to grant a variance <br />for the 6-foot board on board fence to be erected at the 25 foot se.t back and <br />parallel with the sidewalk and the road, the gate is.to be closed after each <br />using and is to remain-closed at all.times except when in use, the greenery <br />will stay, and is to be placed, except for the front, exactly as submitted, <br />with the condition that the uarking spaces in.front of.the landscaped area <br />be striped, seconded by B. Grace, and unanimously approved. Variance granted, <br />Mr. Conway would like Mr. PaPpato to present a nroposal to the Planning <br />Commission which would.address the parking on Dover Center Road. <br />3. Richard Arth, 25173 Deerfield Dr. <br />Request for variance (1123.12). Request 22 foot rear yard variance for patio <br />enclosure. Violation of Ord. 87-93,.Section 1135.08. <br />Chairman Remmel called all interested narties before the Board. The oath was <br />administered to R. Borchert, contractor.. Mr. Remmel stated that the enclosure <br />is large and cuts down on the:back yard considerably. Mr. Borchert explained <br />that the. enclosure is all glass. B. Grace moved to approve the 22 foot rear <br />yard variance for a patio enclosure for Mr. Richard Arth, 25173 Deerfield Dr, <br />seconded by J. Helon. Roll call on motion: Grace, Helon, and Bugala, yes. <br />Mr. Remmel, no. Motion carried. Variance granted. <br />4. Stan Ki.czek, 6095 Pebblebrook Lane.(Sublot 35). <br />Request for variance (1123.12). Request 9 foot rear yard variance to construct <br />dwelling. Violation of Ord.. 87-93,'Section 1135.08. <br />Chairman Remmel called all interested parties before the.Board. The oath utas <br />administered"to J. Kiczek, his son, and J. Christiano, Bennet Builders.
