The oath was <br />administered to Mr. Piersona representing the church, and Mr. Folley, a neighbor, <br />who exnlained that he had asked the church to put up the fence to shield his <br />property from car lights, explaining that his bedrooms are next to the drive. <br />Mr. Gomersall believes that a 5foot fence would be sufficient. Mr. Pierson <br />explained that Mr, Vo11ey`s property is higher, that members of the church <br />had checked and they determined that a 5 foot fence would not obscure the <br />lightsa Law Director Gareau advised the Board that an ordinance has been <br />introduced which would allow a six foot fence, but has not been passed as yet. <br />It was decided that this request could be continued for 90 days since this <br />would be sufficient time for the ordinance to be either approved or denied. <br />C, Remmel moved to grant a 90 day continuance to the North Olmsted Assembly <br />of God Cliurch request, seconded by J. Helon, and unanimously approved, Request <br />continued. <br />4, Ray Judkins, 4447 Columbia Road <br />Request for variance (.1123.12).. Request 150 square foot variance and 2 foot <br />side yard variance to replace former detached garaget Violation of Ord. 87-93, <br />Section.1135.02(c)--1. <br />Chairman Remmel called all interested parties before the Board. The oath was " <br />administered to R. Judkins and E. .7udkins, his father, who explained that they <br />wish to place the new garage on the old foundation. Tt was noted that there <br />were 2 letters and a phone call from neighbors stating that they were in favor <br />of the variance. Mr. Remmel pointed out that the old foundation has been <br />raised by tree roots and has cracks in it. Mr. Bugala does not believe that <br />this foundation would be sound enough to put a new garage on it, Mr. R. Judkins <br />stated that the foundation walls are stable and he thinks there are 3 foot <br />footers under it, only the floor is cracked, 14r, Remmel pointed out that <br />there is a hill next to the garage and a 2.5 £oot side yard would not be large <br />enough for them to work on the garage. Mr,.Judkins stated that they could <br />have repaired the garage without a variance, and if they have to pour a new <br />pad they will not have additional money to upgrade the house as they had plan- <br />ned. R. Buga.la moved to grant the 150 square foot variance and 2 foot side <br />yard variance to replace former detached garage for Ray Judkins, 4447 Columbia <br />Road, seconded by J. Helon. Request variance to have 37 parking spaces <br />less than requi,red, Vi,olation of prd. 87-93, Section 1161.05(r). <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Glueck of McDonald's who explained that 31 of the spaces <br />requested were for a community room which is planned for the basement of the <br />new facility. He presented a letter stating that this room would be used for <br />community groups and training and only during off peak hours; it would not be <br />available for use between 11:00 a.m, to 2:00 p.m. and 5:00 p.m. to 7:00 pem. <br />He also presented a survey taken today which showed that only 36% of their <br />seats were occupied during the lunch hour (11:00 a.m. to 2:00 p.m.) Building <br />Commissioner Conway advised that he was there at 12:30 p.m. today and there <br />were only one or two cars in the rear row of parking. Mr. Glueck pointed out <br />that the new buil.ding will be set back about 80 feet in order to provide more <br />stacking area for cars using the drive through window and that they have 60 <br />parking spaces at present and will be providing 66 with the new construction. <br />Chairman Remmel administered the oath to Mrs. Kordish, a resident, who viewed
