He is concerned that commercial uses are encroaching <br />into this residential area, and pointed out that behind him they are building <br />$220,000 homes and would like to see this residential use expanded. Mrs. <br />Baracskai stated that for the last four years they have been holding services <br />in another building and questioned if the neighbors have noticed an increase in <br />traffic from this use (not from Great Northern). She maintained that since <br />they will be using a different access for this facility it will improve the <br />traffic pattern because their traffic will not be coming onto Columbia Road. Mr. Giesser presented brochures from the cemetary which advertises these <br />services. Chairman Remmel stated that the Board had heard all these arguments <br />previously and is aware that the neighbors are opposed. Mr. Remmel then stated . <br />that since the refusal of the variance or modification shall deprive the owner <br />of the premises sought to be used of substantial property right and the granting <br />of this variance, modification, or ruling shall not be contrary to the p:urposes <br />and intents of the provisions of the Zaning Code, for that reason we find that <br />. 1135.01 which states the use restrictions in "A", "B", and "C" Residence Districts, <br />Chapter 4 says "Cremetories in cemeteries existing on the date of the passage of <br />the Zoning Code, provided no part therof is closer than 300 feet to its lot line <br />adjacent to any residence district; or school, libraries, museums, and so forth;. <br />we are going to rule that it applies to chapter 4 of 1135.01 with a few restric- <br />tions, one of the restrictions is that it is limited as in the request for the <br />purpose of viewing of the deceased, but know it cannot be interpreted as a <br />mortuary, it cannot be interpreted for embalming purposed, it can be used only <br />as chapel purposes. B. Grace moved for the request for ruling to determine <br />whether the erection of a building to be used for services.and viewing of <br />deceased persons is a permitted use in a Residential District, Section 1135.01, <br />continued from the last meeting for Sunset Memorial Park Association, 6265. <br />Columbia Road, seconded by.J. Helon. Roll call on motion: Grace, Helon, Gomersall, and Remmel, yes. Bugala, no. Motion carried. <br />T. J. Maxx, 25959 Lorain Road <br />Request for variance (1123.12). Request 51.0 square foot variance for sign <br />on rear of building. Also request 148.3 square foot variance for total sign <br />area. Violation of Ord. 87-93, Section 1153.06(d). <br />(Continued from meeting of,July 6, 1988). <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Ms..Storer,.First Neon Sign Company. Mr. Remmel questioned <br />if the move being made by the Rini's store in that center would have any <br />effect on the sign area. Building Commission Conxoay responded that the new <br />signage for the former Ririi's unit has been proposed and the rear signage <br />is being removed. He further advised that the figures stated in the agenda <br />should be adjusted and the total sign area variance should be 130. square feet, <br />not 148.3 as stated. Mr. Bugala believed that the Board had been yery liberal <br />in allowing the T. J..Maxx sign to be installed previously, considering the <br />size of the Zayre's sign, and he does not believe that the rear sigri is necessary. Ms. Storer stated that the owner would like to identify the rear <br />entrance for shipping purposes. Mr. Conway advised that they would be allowed <br />an 18 square foot sign for a secondary street, however they would still need <br />a variance for the total sign area since they are alreadg over the total allowed. <br />The proposed sign is 51 square feet. R. Bugala moved to grant a 51 square foot <br />variance for sign on rear of building and also a 130 square foot variance fo.r <br />total sign area for T: J. Maxx, 25959 Lorain Road.
