BOARD OF ZONING APPEALS JULY 6, 1988 PAGE 3 <br />travelled and many cars travel at excessive speeds; they maintain that such a <br />facility would increase this traffic since there would be viewings every <br />night, that the parking lot would be visible from their residentially zoned <br />property; and that such a facility would devalue their property since it is <br />a commercial business. Mr. Bugala stated that he believes that the owner <br />should be requesting a rezoning and agreed that this is a commercial use. <br />Mr. Giesser stated that the cemetary is a permitted use in a residential <br />neighborhood. C. Remmel moved to grant the request: Mr. Bugala pointed out <br />this would not be a request for a variance, but for a ruling. After some <br />discussion, C. Remnel moved that the Board refuse the ruling to determine <br />whether the erection of a building to be used.for services and viewing of <br />deceased persons in Sunset Memorial Park is a permitted use in a residential <br />district. Chairman Remmel explained that the Board was refusing to make a <br />ruling, if the Board does not make a ruling, it stands as is. Motion was <br />seconded by R. Gomersall, and unanimously approved. P.uling refused. Mr. <br />Giesser questioned if the Board could refuse to make a ruling. Chairman <br />Remmel suggested-tie talk with the Law Direcfor: Request was discussed again <br />at the end of the meeting. Mr. Welms is questioning why he did not receive <br />a notice. He was advised that he was not directly.across the street from <br />the property. Building Commissioner Conway will talk with him in his office <br />during business hours. <br />4. Therese Horwedel, 24197 Woodmere Request for variance (1123.12). Request 13 foot rear yard variance.for <br />addition. Violation of Ord. 87-93, Section 1135.08. <br />Chairman Remmel called a1T interested parties before the Board. The oath was . <br />administered to Mrs. Horwedel-and Mrs. Evanoff, a friend. Board has no <br />problem with this request. R. Gomersall moved to grant a request for a 13 foot ? <br />rear yard variance for an addition to Therese Horwedel, 24197 Woodmere, seconded <br />by R. Bugala, and unanimously approved. Variance granted. <br />5. North Olmsted Medical Center, 25761 Lorain Road <br />Request for variance (1123.12). Request 4 foot 8 inch location variance for <br />ground sign (building permit issued and sign is installed). Violation of <br />Ord. 87-93, Section 1163.06(f)2. ' .. <br />Chairman Remmel called•all interested parties before the Board. The oath was <br />administered to Mr. Kalina, Brilliant Elect'ric Sign Company, who explained <br />that they'had'submitted a site plan and a iiraw-ing of the sign and were issued <br />a permit. At a later time they were notified that the sign was tob close to <br />Lorain Road. He stated that he had taken measurements from the center line <br />of Lorain Road, and from the telephone lines which are usualiy at the right- <br />of=way line, but has sinee found out that this is not the case on Lorain Road. <br />He pointed out that this sign is behind most of the others -in the area. <br />Building Commissioner Conway explained that this pe?-mit was issued before he <br />was with the city and he will not close out fhe permit until this discrepancy <br />was cleared up. He further explained that the right-of-way line is usually <br />a foot behind the sidewalk so that the sign should be 8 feet from the side- <br />walk, and that the right of way line in this case was determined by the <br />Engineering Department. The Board has no problem with this request. C. <br />Remmel moved to grant the request for a 4 foot 8 inch location variance for <br />this ground sign, seconded by R. Buagla, and unanimously approved. Variance <br />granted.
