BOARD OF ZONING APPEALS JULY 6, 1988 PAGE 4 <br />6. James J. Gudin, 27917 Forestwood Parkway <br />Request for variance (1123.12). Request 44 square foot variance and 6 foot <br />height variance for gazebo. Violation of Ord. 87--93, Section 1135.02(d). <br />(Ruling by the Board of Zoning Appeals on September 2, 1987 determined <br />gazebo was a like and similar use to a tool shed). <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Gudin. Building Commissioner Conway advised that since <br />the Board had previously determined that gazebos were a similar use to a shed, <br />most of these structures would need variances for height and square footage. <br />Mr. Gomersall believes that the structure is too high. Mr. Gudin stated <br />that the original plans showed less of a pitch, but there was concern over <br />proper drainage of snow. He has no objection to changing the pitch of the <br />roof and lowering the gazebo, and pointed out it would be between three large 8/3/88 <br />trees and would be mostly obscured from adjacent neighbors.. It was agreed correction <br />that a 5 foot height variance would be acceptable. R. Gomersall moved to and locatic <br />grant a 44 square foot variance and a 5 foot height variance/for a gazebo variance <br />for Mr. James Gudin at 27917 Forestwood, seconded by C. Remmel, and unanimously <br />approved. Variances granted. <br />7. T. J. rfaxx, 25959 Lorain Road <br />Request for variance (1123.12). Request 51.0 square foot variance for sign <br />on rear of building. Also request 148.3 square foot variance for total sign <br />area. Violation of Ord. 87-93, Section 1135.08(a). <br />Chairman Remr.iel advised that the applicant.had requested that this item be , <br />continued until next month since there are only three members present. <br />Request continued. <br />8. Douglas A. Counts, 4639 Brendan Circle <br />Request for variance (1123.12). Request 16.5 foot rear yard variance for <br />raised deck. Violation of Ord. 87-93, Section 1135.08(a). <br />Chairman Remmel called all interested parties before the Board.. The oa.th was <br />administered to Mr. and Mrs. Counts. The Board agreed that this was an unusal <br />lot. Mr. Counts explained that the top level of the deck will be replacing a <br />porch that was there previously. Chairman Remmel no.ted that no neighbors <br />were present. R. Bugala moved to grant the 16.5 foot rear yard variance for <br />a raised deck for pouglas A. Counts at 4639 Brendan Circle, seconded by <br />R. Gomersall, and unanimously approved. Variance granted. <br />9. Ronald W. Hicks, 5368 Wellesley Ave. . <br />Request for variance (1123.12). Request 1 foot side yard variance to add to <br />detached garage. Violation o.f Ord. 87-93, Section 1165.02. <br />Chairman Remmel called all interested parties before the.Board. The.oath was <br />administered to P1r. and Mrs. Hicks who advised that they wish to add to their <br />existing non-conforming garage in order to have more storage area. The Board <br />has no objection to the request. C. Remmel moved to grant the special permit <br />to add to a non-conforming garage and the 1 foot side yard variance to add <br />to the detached garage, seconded by R. Bugala, and unanimously.approved. <br />Variance and special permit granted.
