BOARD OF ZONING APPEALS JULY 6, 1938 PAGE 7
Chairman Remmel called all interested parties before the Board. The oath was
administered to to Mr. and Mrs. Ekstrand who advised that they only needed a
2 foot 2 inch variance off the rear property line. Building Commissioner
Conway explained that a deck by itself could be 3 feet off the property line,
but when it is an appurtenance to a pool it must be 10 feet from the.line.
Mrs. Ekstrand explained that because their property drops down 3 feet, they
cannot relocate their pool. Mr. Ekstrand explained that when they installed
the pool they placed it 11 feet away from the line, but had told the inspector
that he intended to put a deck around the pool instead of just a fence on the
top. It was clarified for Mr. Gomersall that only the deck needed that variance,
the pool conformed. R. Bugala moved to grant a location variance for a 2 foot,
2 inch variance off the rear property line and a 1 foot 8 inch variance off
the side property line, seconded by R. Gomersall-, and unanimously approved.
Variances granted.
Law Director Gareau had returned to the meeting. He advised the Board that
he had been told that the Board had refused to rule on the Sunset Memorial
Park request and that Board did have to make a ruling when it was requested.
Since the adjacent residents had left the meeting, Mr. Giesser offered to
withdraw the request until the next meeting so that the neighbors can be
notified again.
The meeting was adjourned at 9:30 p.m.
C.
