? <br />,?? - -• <br />CITY OF NORTH OLDISTED <br />BOARD OF ZONING APPEALS <br />MINUTES-NOVENrBER 2, 1988 <br />Chairman Remmel called the meeting to order at 7:30 p.m. <br />Present: R. Bugala, R. Gomersall, B. Grace, J. Helon, and C. Remmel <br />Also Present: Law Director M. Gareau, Building Commissioner D. Conway, <br />and Clerk of Commissions B. Oring. <br />R. Bugala moved to accept the minutes of the meeting of October 5, 1988 as . <br />written, seconded by J. Helon. Roll call on motion: Bugala, Helon; Gomersall, <br />and Remmel, yes. Mr. Grace abstained. <br />Marvin and Karen Stotz, 23968 Maple Ridge Road <br />No representative present. Request was discussed later•in the meeting. <br />1. Shirley Thomas-Heil., property located behind 26540 Butternut Ridge Road <br />Request for variance (1123.12). Request 558 foot front'setback variance to <br />build single dwelling. Violation of Ord. 87-93, Section 11.35.06(a): <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to R. Isabell, builder; Mrs..Thomas-Heil,-owner; Mr. Thomas, her <br />father.; and Mr. and'Mrs: Williamson; who own the adjacent property: This lot <br />is behind another lot with a house on it. Mr. Thomas explained to.the Board <br />the location of the proposed house in relation to another hous.e on a rear lot <br />in the same area. P1rs..Williams is concerned about flooding problems because <br />her pronerty is lower, pointing outthat".there?had been drain tiles but they <br />had been destroyed over the years, and also that this property had been a. <br />city land fill. Building Commis'sioner Conway explained that the Engineering <br />Department will have-to approve these plaris and will require that property <br />will have to connect to.the sewer system: He further advised that these two <br />lots have been recorded since 1926 arid 1944. Chairman Remmel is concerned <br />since the driveway is narrow and Fire Department vehicles might not be able <br />to get back there. Law Director Gareau advised that'the easement had beeri <br />there for years and they couTd not be forced to widen it. B. Grace moved to <br />grant the request for a variance for a 558 foot front set back to build a <br />single dwelling for Shirley Thomas-Heil on property located behind 26640 <br />Butternut Ridge Road, seeonded by R. Gomersall. Roll call on motion: Grace,, <br />Gomersall, Bugala, and Helon, yes. Mr. Remmel, no. Motion carried. Variance <br />granted. <br />2. Jay Holda, 5943 Stearns Road <br />Request for variance (1123.12). Request-186 square foot variance for garage <br />area to construct detached garage. Violation of Ord. 87-93, Section 1135.02(c)1. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Holda who explained he iaill eventually be installing a <br />gravel drive, but the garage would be used mainly.for storage of his 1961 truck <br />and for lawn equipment,'explaining that he has a large lot and only has a single <br />garage. T-he Board noted that his request stated that he wanted to store two <br />classic cars. He explained that the garage would be 24 feet by 24 feet, 12 <br />feet high and would have two single doors. C. Remmel moved to grant the vari- <br />ance as requested, seconded by B. Grace, and unanimously approved.. Var.iance <br />granted.
