BOARD OF ZONING APPEALS JUNE 8, 1988 PAGE 8 <br />Also request special permit to add patio enclosure to non-conforming dwelling <br />(front set back). Special permission required Ord. 87-93, Section 1165.02. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Stover. Mr. Bugala stated that this is much too <br />close to the garage and suggested moving the enclosure into the "L" portion <br />of the house. Mr. Remmel suggested that a walkway could be installed from <br />the kitchen to an enclosure in the "L". R. Bugala moved to grant the 17 foot <br />variance between the patio enclosure and detached garage and a special permit <br />to add to a non-conforming dwelling, seconded by C. Remmel. Roll call on <br />motion: Bugala, Remmel, Gomersall, Grace, and Helon, no. Motion failed to <br />pass Variance denied. <br />15. Donald Huebler, 6753 Louann Dr. <br />Request for variance (1123.12). Request 7.5 foot rear yard variance for <br />patio enclosure. Violation of Ord, 87-93, Section 1135.08(a). <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Huebler. Board had no objection. R. Bugala moved to <br />grant the 7.5 foot rear yard variance for a patio enclosure for Mr. Donald <br />Huebler, 6753 Louann Dr., seconded by B. Grace, and unanimously approved. <br />16. Martin V. Raffay, 3828 Root Rd. <br />Request for variance (1123.12). Request 398 square foot variance for garage <br />area to construct enclosed patio on detached garage. Violation of Ord. 87-93, <br />Section 1135.02(c)-1. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Raffay who explained his house was brick and it was easier <br />to attach a patio to the garage. Board has no objection. J. Helon moved to <br />grant the request for a 398 square foot variance for garage area to construct <br />enclosed patio on detached garage; seconded by C. Remmel, and unanimously <br />approved. Variance granted. <br />17. Mr. and Mrs. B. Wagner, 4376 Dover Center Rd. <br />Request for variance (1123.12). Request 45 foot rear yard variance to construct <br />carport. Violation of Ord. 87-93, Section 1135.08(a). Also request special <br />permit to add to non-conforming dwelling. Special permission required Ord. 87-93, <br />Section .1135.02(c). <br />Chairman Remniel called all interested parties before the Board. The oath"was <br />administered to Mr. Wagner who explained that they are maintain and extending <br />the existing porch roof and removing the porch decking in order to build the <br />carport. The roof must be remain at this height to conform to the house <br />and the roof line will match the roof line of the house. Mr. Remmel wants it <br />specified that there would be no commercial trucks stored under this structure. <br />C. Remmel moved to grant the 45 foot rear yard variance to construct a car- <br />port as requested.and the special permit t.o add to a non-conforming dwelling <br />with the understanding that.the carport cannot be used for any commercial <br />purgose, including storage of trucks, etc., seconded by B. Grace, and <br />unanimously approved. -Variance and special permit granted. - <br />? 16. C. F. Sidloski,- 28043 Angela Dr. <br />Request for variance (1.123,1:2). Request 1 foot height variance for fence. <br />Violation of Ord. 87-93, Section 1135.02.
