BOARD OF ZONING APPEALS JUNE 8, 1988 PAGE 7 <br />11. Richard D. Armbruster, 5599 Revere Dr. <br />Request for variance (1123.12). Request 1 foot height variance for fence. <br />Violation of Ord. 87-93, Section 1135.02(h). <br />Chairman Remmel called all interested parties before the Board. The oath was <br />adminstered to Mr.. Armbruster. Chairman Remmel stated that a neighbor advised <br />him that he was going to send a letter objecting to the variance, it was <br />pointed out that two letters were received objecting to the variance. Mr. <br />Armbruster stated that the neighbor's pool was 10 feet away from his patio and <br />that a S foot fence would not give them any privacy. Board has previously <br />turned down similar requests. Mr. Armbruster stated that each case was to be <br />considered individually and none of his neighbors had objected to him, He was <br />advised that he could have a 6 foot privacy screen, 16 feet in length and <br />placed 5 feet from his.property line. R. Bugala moved to grant the 1 foot <br />height variance for a fence for Richard D. Armbruster at 5599 Revere Dr. <br />seconded by J. Helon. Roll call on motion: Bugala, Helon, Gomersall, Grace, <br />and Remmel, no. Motion failed to pass. Variance denied. <br />12. John W. Lekas, 4175 Columbia Road. <br />Request special permit to add to nori-conforming dwelling (front set back) and <br />non-conforming garage (side yard). Special permission required Ord. 87-93, <br />Section 1165.02. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Lekas who explained that a fire wall would be installed <br />between house and attached garage and the entire s.tructure would be sided. <br />Building Commission Conway noted that the plans show the fire wall on the <br />addition side of the structure and he should firewall the garage. B. Grace <br />moved to grant the request for a special permit to add_to non-conforming <br />dwelling (front set back) and non-conforming garage (side yared) for Mr. John <br />Lekas at 4175 Columbia Road with the condition that they conform to the <br />suggestions of the Building Commissioner for the erection of the fire wall on <br />the garage side of the addition, seconded by R. Bugala, and unanimously approved. <br />Variance granted. <br />13. Mr. and Mrs. T. Pavek, 3523 Clayton Dr. <br />ltequest for variance (1123.12). Request 43 foot rear yard variance for patio <br />enclosure. Vi&lation of Ord. 87-93, Section 1135.09(a). Also request 3 foot <br />variance for distance between dwellings. Violations of Ord. 87093, Section <br />1135.07(a). <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Pavek, neighbors, Mr. and Mrs. Follan, and a <br />representative of Patio Enclosures. The Follans are objecting because the <br />enclosure is only 12 feet from their house. The contractor stated that it <br />would appear that this is a side yard, not a rear yard. Law Director Gareau <br />agreed that it was a side yard. Chairman Remmel pointed out that they would <br />still tie too close because there was not the requred 15 foot set back between <br />dwellings. The Board has turned down similar requests. C. Remmel moved t'o <br />grant tYie variances- as requested, seconded by J. Helon. Roll call on motion. <br />Remmel, Helon, Bugala, Gomersall, and Grace, no._ Motion failed to pass. ' <br />Variance denied. <br />14. Mr. and Mrs. Robert Stover, 3625 Clague Road : . <br />Request for variance (1123.12). Request 17 foot variance between patio <br />enclosure and detached garage. Violation'of Ord. 87=93, Section 1135.02(c)-1.
