BOARD OF ZONTNG APPEALS JUNE 8, 1988 PAGE 6
8. St. Clarence Church, 30106 Lorain Road
Request for variance (1123.12). Request 15 foot front set back variance for
bell tower. Also request 20 foot height variance for bell tower and cross.
Violation of Ord. 87-93, Sections 1139.04(a) and 1139.03.
Chairman Remmel called all interested parties before the Board. The oath was
administered to the Reverend Father Flynn and R. Zarzycki; architect. Building
Commissioner Conway advised that Ordinance 88-36 had been passed allowing
Planning Commission to accept a 35 foot front set back providing that the
set back is landscaped, so this would be a mute point. Law Director Gareau
advised that technically this ordinance is not in effect as yet since the
30 day period is not over. Board had no problems with the requests. R.
Bugala moved to grant the 15 foot front set back variance with the stipulations
of the new ordinance that the front set back be landscaped and to grant the
20 foot height variance for the bell tower and cross for St. Clarence Church
at 30106 Lorain Road, seconded by J. Helon, and unanimously approved. Variances
granted.
9. Andreas and Christine Mealey, 5816 South Porter Road
Request for variance (1123.12). Request variance to place swimming pool on
vacant lot (abutting lot with dwelling). Also request 5 foot variance for
location of pool from property line. Violation of Ord. 87-93, Section 1135.02
and 1135.03(1).
Chairman Remmel called all interested parties before the Board. The oath was
administered to Mr. and Mrs. Mealy and Mr. and Mrs. Gallo, neighbors. Pool is
located on a vacant lot next to the lot where the Mealey`s house is located,
and the 5 foot variance is on the Mealey's property line, not the adjacent
neighbor's line. The Gallos are not objecting to the proposal, they are con-
cerned about the fence. It was explained that the fence and pool equal 6 feet
from the ground and this conforms to the ordinance. It was further clarified
that there is a'.lifted and locked stairway to the pool. B. Grace moved to
grant the variance to place a swimming pool on a vacant lot (abutting lot with
dwelling) and the 5 foot variance for location of pool from the property line
for Andreas and Christine Mealey, 5816 S. Porter Road, seconded by R. Gomersall.
Roll call on motion: Grace, Gomersall, Bugala, and Helon, yese Remmel, no.
Motion passed. Variance granted. --
10. Westside Volkswagen, Inc. AKA Ganley Westside imports, 25600 Lorain Road
Request for variance (1123.12). Request variance to display 10 cars in front
set back. Violation of Ord. 87-93, Section 1139.04(a).
Chairman Remmel called all interested parties before the Board. The oath was
administered to Ms. Perry, representing Westside Volkswagen, who explained tha-t
they would like to landscape the first 7 feet and pave approximately 23 feet
of existing grass area and display approximately 6 to 7 cars, probably not
10 as stated in the request. Mr. Gareau.stated that this is totally contrary
to the current thinking of the City and pointed out that they have a front
display area on an adjacent section of their lot. Mr. Bugala stated that this
lot is totally over parked. R. Bugala moved to grant the variance to display-
10 cars in the front'set-back of the Westside Volkswagen aka Ganley Westside
Imports, 25600 Lorain Road, seconded by B. Grace. Roll call,on motion: Bugala,.
Grace, Gomersall, Helon,-and Remmel, No. Motion failed to pass. Variance
denied. . ?
