It was explained to <br />the neighbors that there would be 5 feet of landscaping between the parking <br />lot and the property line and that a retention system would be installed: <br />Mr. Dunn is concerned since there is a storm sewer for his property which <br />might be affected. Law Director Gareau advised that the Engineering De- <br />partment must review and approve the drainage and the retention s,ystem, and <br />thts is not up to this Board. Mr. Remmel requested a motion on the aceess <br />drive onl_y. R. Bugala moved to grant the variance for a single drive for <br />Fish Furniture, 23770.Lorain Road, seconded by C. Remmel and unanimously <br />approved. Regarding the loading. zones, Mr. Geller explai.ned that their only <br />deliveries are on Monday and Thursday mornings by van from their warehouse <br />and evening trash pick up also by van; the rear parking area would probably <br />be used by employees; and their parking lot is rarely filled, he estimated a <br />maximum of 22 to 22 customer cars during their peak business hours. Mr. Gareau <br />pointed out that the number of cars in and out of a furniture store is far <br />less than other businesses. Mr. Bugala and Mr. Grace prefer a six foot <br />fence rather thanthe landscaping on the.property line and the neighbors <br />agreed. Mr. Gareau advised this should be a condi.tion of the variance. Cotm cilman Wilamosky would like a fence or buffer provided along the eastern <br />side of the lot adjacent to residential property. B. Grace moved to approve <br />the request for a variance for a loading zone within the 50 foot rear buffer <br />adjacent to residential property, with the condition that a six foot solid <br />fence be constructed along the rear property line adjacent to residential <br />property and also that parking spaces number 31 through.40 be reserved for. <br />employees only and so indicated by proper': signage, seconded by R. Bugala, . <br />and unanimously approved. R. Bugala moved to grant the variance for 1 parking <br />space for Fish Furniture, 23770 Lorain Road, seconded by B. Grace., and.unani- <br />mously approved. C. Remmel moved to-issue a special permit to add to a <br />non-conforming building, seconded by C. Remmel, and unanimously approved. <br />Variances and special permit granted. - <br />2. E. M. Zoldesy, 5015 Evergreen Dr. <br />Request for variance (1123.12). Request 1 foot height variance for tool <br />shed (building permit issued for 8 foot shed; 9 foot shed was cons.tructed). <br />Violation of Ord. 87-93, Section 1135.02-3. <br />Ch'airman Remmel called all interesteiiparties before the Board. The oath was <br />administered to'Mr, Zoldesy who explained that he was advised by the seller, <br />an agent for Alpine Structures, that the sfied would be within the ordinance; <br />he was unaware that the shed was too high until the inspector notified him. <br />He_claims-that he was not told that there was a height limitation when the <br />permit was issued (permit application stated 8 feet high). Chairman Remmel <br />stated that this is a good looking structure and that the one next door was <br />practically as high. - Mr. Grace pointed out that the Board has previously required that shed be lowered and believes that the Board must be consistant. <br />Mr. Remmel stated that others on the street would probably. request the same . <br />variance. J. Helon moved to grant a variance-for a tool shed from 8 foot to <br />9 foot for E. M. Zoldesy, 5015 Evergreen Dri.ve, seconded.by C. Remmel. Roll <br />call on motion: Helon, Bugala, and Grace, no. Mr. Remmel, yes. Motion <br />failed to-pass. Variance denied. Mr. Zoldesy was advised to have the con- <br />tractor reduce the height of the shed. Mr. Conway stated that the Building <br />Department advises homeowner of the code requirements for shed5.
