T ? <br />BOARD OF ZONING APPEALS JANUARY 6, 1988 PAGE 7 <br />objections to the reques.t because the westernmost drive is too close to the <br />adjacent Clark Gas Station drive which is frequently congested. Mr. Grace <br />believed that most of the traffic would use the westernmost drive since the <br />e.astern drive would be more of a service drive to the rear of the building. <br />Law Director Gareau pointed out that the three parking spaces next to the <br />western drive would not be useable and agreed that there would be a problem <br />with a drive in that location. Mr. Helon suggested th at they make a study of <br />the tra£fic at this point before proceeding on the proposal. Mr. Gareau <br />suggested landbanking the front spaces in green area if ttie Board would grant <br />a variance to have smaller spaces. Neighbors are concerned about the rear <br />buffers and were advised that these would be addressed by the Planning <br />Commi.ssion. Tt was suggested that the reques.t be continued and the architect <br />return with a new plan next month. Mr. Certo stated that they have an-alter- <br />nate, conforming plan to present to Planning Commission if variance is not <br />granted since the_y want to get their Planning Commission approvals this month <br />and he withdrew the request. Law Director Gareau suggested that he could <br />come back for-the variance for smaller spaces in order to have more green <br />area after he gets other-approvals and stated that a green area in the front <br />parking spaces wduld definite.ly-improve the appearance of the center. Request <br />withdrawn. - <br />9. John R. Bryan, Jr., 5803 Stearns Rd. <br />Request for variance (1123.12). Request 1,170 sq. ft. variance for total <br />garage area (1,200 sq. ft. existing and 720 sq. ft. to be added). Violation <br />of Ord. 87-93, Section 1125.02. <br />Chairman Remmel called all'interested parties before the Board. The oath was <br />administered_.to John Bryan raho explained that he collects cars as a hobby and. <br />wants to keep them under cover, he has no.intention of using garage for com- <br />, mercial purposes. Mr. Bryan explained that originally there was a larger <br />structure on the property (approximately 1;200.square feet) which had been <br />added on to several times. That had been dama.ged by a fire and because of <br />problems.with the insu-rance company it was condemned. After having talked to <br />the former Building Commissioner he took out a permi.t to have the garage <br />demolished. After he boug'Htt'hp- materials, he tried to get a building permit <br />and was told he would need a variance. He was told it would be approximately <br />30 to 60 days before he could go-to the Board and since it was November, and <br />the contents of the garage and the building materials were outside, he built <br />the garage. Now he would.like a variance to keep the structure he has and <br />to add to it so that he can keep everything°inside. Mr. Gareau stated that <br />the court has refe'rred this back to the Board. Mr. Grace pointed out-that no <br />neigHbors are present to object. Mr. Remmel believes that the building could <br />be a problem with the next owner.: Councilman Wilamosky pointed out that Mr. <br />Biyan had previovsly been to Planning Commission at another location, requested <br />-approval's of a plan, had it b uilt and then went out of business;. he is ques- <br />tioning what will happen if the Board allows this structure to be comnleted. <br />Mr. Conway advised that this is a pole building and meets code, but ttie <br />footers.would have to be inspected.. C. Remmel moved to grant the variance <br />for the 1,170-square foot garage which is now erected only on the condition <br />that it meets the city requirements b ut the 720 square foot addition must be <br />removed, and also with the condition that it cannot be used for any commerical <br />? use, not be be used as a truck garage or any commercial.establishment.. Mr. <br />Bryan stated that the exi.sting structure has been up for several years and <br />' at no time has he ever done any commerical work out of the building. He .
