The future nature of this property could pose a safety <br />hazard to the customers of these businesses should eitlier business <br />change causing the number of vehicles ingressing or egressing the pro- <br />perty to increase materially. Therefore I move that we approve the <br />Home Centers, Incorporated, proposal to construct a building at the <br />rear of Bob Evans Restaurant at 25853 Lorain Road contingent upon the <br />following two recommendationse The first recommendation concerns occu- <br />pancy. As part of th.is approval the occupancy permit for Bob Evans will . <br />be immediately revoked and will be replaced by a temporary occupancy <br />permit; additionally a temporary occupancy permit will be issued to Home <br />Centers. Should the occupancy of eittier of these buildings change in <br />such a way as to provide a greater amount of traffic generated than the <br />combined usage of the current occupancies of these buildings, as supported <br />by an independent traffic study using the most current edition of the <br />Transportation Engineering Traffic Generation Report, then the occupancy <br />permit will be revoked and the new occupants must return to this Commis- <br />sion for approval. This should address the concern of two high volume <br />businesses occupying the pxoperty and significantl.y increasing•traffic ". <br />and thus jeopardizing safety. The second contingency of this motion is <br />that 7 parking spaces in the front, namely, the three on the west side of <br />the entrance drive and the four on the east side of the entrance drive <br />will be removed and landscaped in order to allow a safer ingress to this <br />property for the additional traffic. This should alleviate our concern <br />for vehicles backing out into those vehicles trying to access the parcel. <br />This motion includes all the recommendations of the Architectural Board <br />of Review, seconded by M. Betts, and unanimously approved. Law Director <br />Gareau stated that he does not believe that the occupancy permit that <br />was granted to Bob Evans should be changed, because a procedure of due <br />process would have to be followed, but if that portion was left out and <br />it was simply indicated that the permit that Home Centers would possess <br />would be a temporary occupancy and if t1?ey sold the property or changed <br />it dramatically this would be revoked. He further pointed out that if <br />the Bob Evans property changed, it would have to be brought back before <br />the Commission. Mr. Gorris stated that they would not have to come be- <br />fore the Commission unless there was a change to the parking lot or the <br />building, and he wanted to ascertain that the future use of the front <br />half of the property is also addressed. Mr. Gorris stated that he was <br />convinced that if this proposed development is built on the back parcel, <br />provided that the indicated front parking spaces are removed to allow a <br />smooth flow of traffic, this would be a good development of the parcel. <br />However, he did not want to say to Home Centers you cannot change your <br />occupancy without similar restrictions on the front half of the parcel. <br />Mr. Morgan stated that he would have a problem changing the occupancy <br />permit for Bob Evans, but he would have no problem requiring that any <br />change in the occupancy for Bob Evans, regardless of whether it was a <br />restaurant or not, would.be brought back before the Planning Commission <br />for review, Mr. Gorris stated that he would change"his motion to read: <br />to recommend that we approve the Home Centers, Inc., proposal to con- <br />struct a building at the rear of the Bob Evans Restaurant at 25853 Lorain <br />Road contingent upon the following recommendations: 1) the occupancy <br />permit of the front development on this parcel will be reviewed by the <br />Planning Cotmnission upon any change in business on that portion of the
