<br />PLANNING COMMISSION MAY 23, 1989 PAGE 4 <br />In reference to the site plan, Mr. Cody, architect, stated that there <br />were two plans presented, one with a conforming 77 parking spaces and one <br />showing 66 actual spaces and the balance landbanked. Mr. Thomas believed <br />that the Commission must look at both these two uses for this parcel, <br />as well as any future change in the use. It was his suggestion that since <br />the front portion of the Bob Evans lot is usually filled.and since with <br />the new proposal large trucks will be coming through this area, the Bob <br />Evans parking all be relocated to the rear and that there be shared parking <br />with Aome Centers. Mr. Vollman stated that they are not willing to modify <br />the front parking and pointed out that they had no financial interest in <br />this property. Assistant Law Director Dubelko doubte3 that Bob Evans had <br />no financial interest since they hold the lease and should have some sort <br />of control over the lease being reassigned. He advised that the Planning <br />Commission would have-the authority to require modification to both lots <br />(the existing and the proposed) in order to insure safety. P4r. Thomas and <br />Mr. Morgan agreed that the Commission would have to look at the development <br />as a whole, stating that there was no objection to Home Centers, but there <br />might have to be a wider drive, perhaps with an island dividing it and with <br />no parking adjacent to it to insure safety. Mr. Thomas asked the Building <br />Commissi.oner to make an actual seat c•ount at Bob Evans. Mr. Valore pointed <br />out that the drive is practically the size of a 30 foot city street, that <br />Home centers does not generate.much traffic, and that with a 50 year history, <br />and a 99 year lease, the business is not likely to change. A1r. Thomas <br />advised that this proposal will probably be tabled until the next meeting <br />for revision to the parking lot, and would like to discuss the building at <br />this time. He commented that it would appear that the front entrance is <br />on Brookpark Road which has no access and there is no signage on the Lorain <br />Road side. Mr. Cody stated that there would be a variance requested for <br />a pole sign on Lorain Road. Since this proposal was originally presented <br />on March 14th, Mr. Thomas questioned if the developers would be willing to <br />table the proposal considering that they would not be able appear before <br />the Architectural Board of Review until after the next meeting. In refer- <br />ence to the 60 day time limitation for Planning Commission to act, Mr. <br />Dubelko advised that since they had requested to go to the Board of Zoning <br />Appeals and since they had also delayed one month that time would not be <br />considered. Mr. Valore had no problem tabling the proposal, but pointed <br />out that Bob Evans had no intention of changing their parking. Again <br />Mr. Dubelko confirmed that the Commission did have the authority to modify <br />the parking to insure safety, and offered to look at the lease to verify <br />how much control Bob Evans would have. Mr. Bedar, Robert Stark Enterprises <br />owner of the adjacent shopping center, stated that Home Centers would be <br />an asset and would encourage the Commission to approve it.. =In reference <br />to the Commission's questions pertaining to Pir. Stark's objections to the <br />original proposal, Mr. Bedar explained that certain concepts in marketing <br />had changed, but even though their tenants were in favor of this proposal, <br />they would probably not consent to a second access through their property. <br />In view of the fact that this development as submitted is not acceptable <br />to the Commission and since there does not seem to be any meeting of the <br />minds, Mr. Betts suggested that there should be a motion to deny. Pir. <br />Valore stated that the developers are willing to discuss other types of <br />traff ic control, possibly speed bumps, but that Bob Evans had made it <br />clear that they would not give up their front parking, and he also offered <br />to present the lease agreement to the Law Department. Mr. Thomas reiter- <br />ated that the refiguration of the parking lo.t was necessary for the safe <br />use of the property. T. Morgan moved to table the proposal to construct
