<br />PLANNING COMMISSION , MAY 23, 1989 PAGE 5 <br />a building for Home Centers located at the rear of Bob Evans Restaurant <br />and send a copy of the site plan to.the Safety Department calling particular <br />attention to the single driveway or single method of entrance and egress <br />to Lorain Road; to the Building Commissioner asking him in particular to <br />determine the number of spaces required for Bob Evans Restaurant at this <br />time (an actual seat count); asking the developer to submit to the Law <br />Department the documerits and leases to determine the amount of control Bob <br />Evans exercises over the lessee; to have the Building Commissioner take a <br />look at any current developments or projects within the city and the drive- <br />way configuration that might be existing there; and finally, to request <br />that when the developers return to the Commission, they show on their plan <br />the first driveway immediately to the east of their proposal, the first <br />driveway immediately to the west and the relationship of this development <br />to the driveways across the street, seconded by B. Gorris. During the <br />discussion of the motion Mr. Thomas stated that he believed that studying <br />other developments would be delaying what the Commission really needs <br />which is an indication from the developer that they are willing to recon- <br />figure their lot to provide for safety.. Mr. Morgan explained that there <br />have been several developments which are about this size with a single <br />drive of a certain width, Pheasants Run being one of them, since one of <br />their drives is really a service drive. Roll call on motion: Morgan, <br />Gorris, Bierman, Bowen, and Traczyk, yes. Mr. Betts and Mr. Thomas, no. <br />Motion carried. <br />Chairman Thomas advised that item 2 of Seetion TV. would.be heard next. <br />IV. NELi DEVELOPMENTS AND SUBDIVISIONS: <br />2) Ernest and Edith Nemeth Assembly Plat. <br />The proposal is to combine and assemble permanent parcel nos. 233-25-1 and <br />233-25-2, located on the north side of Lorain Road east of Elmhurst Road" <br />(abuts North Olmsted Fire Station on the east) into one (1) parcel which <br />is the site of the.existing Nemeth Commercial Building and a proposed <br />additional parking area. Zoning is Retail Business General for entire <br />frontage to 500 feet from Lorain Road centerline, and "B" Residence, <br />Single for rear (north) portion of the proposed assembled parcel. <br />Mr. Thomas advised that only the assembly of the two parcels would be <br />discussed at this meeting and that the parking plan would be heard at the <br />next meeting. He further pointed out that-this assembly would be creating <br />a split zoned property. Mr. Cesen presented a copy of the plat showing <br />the zone line.and it was"clarified that the larger parcel that is being <br />added to this parcel is split zoned at this time. Mr. Nemeth advised that <br />he is assembling the property in order to add some parking at this time <br />and extend the shopping center later on. Building Commissioner Conway <br />advised that there is a conflict with the Star Lounge which is in the <br />Nemeth Shopping center and they will either have to expand the parking or <br />reduce their seating. Mr. Thomas advised that since the property is <br />split zoned, rlr. Dubelko has suggested that a deed restriction be included <br />that no request will be made to develop or rezone the residential land <br />for commercial use, and that the.land will be maintained as residential <br />property. It was clarified that the first 500 feet would be commercial <br />and the rear 76 feet would be residential. Mr. Nemeth had several ques- <br />tions: could he build apartments on the General Retai:l portion and use the <br />residential portion for the recreat.ion center, if'he could build a house on
