<br />PLANNING COMMISSION MAY 23, 1989 PAGE 6 <br />on the residential portion, or could he grow Christmas trees and sell th.em. <br />Mr. Thomas stated that he could only use the property for single residential <br />purposes, and he doubted that there would be room for a house, and that he <br />could not grow any product on the property that was to be sold. After <br />some discussion9 Mr. Nemeth agreed to the deed restriction and stated that <br />he might use the property for a picnic area for his employees. Mr. Lizanich, <br />a neighbor,expressed concerns that the patrons of the Star Lounge would use <br />the picnic area in the middle of the night and advised of the many complaints <br />he had made to the Police Department and to the Board of Liquor Control <br />regarding the disturbances made by the customers of the bar. Mr. Thomas <br />responded that this is only the combination of the two properties, but at <br />the time the parking lot is submitted the Commission can request sound <br />barriers, fencing, etc. Mr. Conway advised that the parking lot plan would <br />be heard June 13th and the neighbors would be notified. Since this property <br />is now wooded, Mr. Nemeth was advised that trees could not be removed with- <br />out permission. In reference to the complaints about noise, Mr. Thomas <br />offered to write a letter to the Safety Director advising him of the situa- <br />tion. Mr. Schabel, a resident across Lorain Road approximately 200 feet <br />away from the shopping center, complained that he could hear cars racing <br />at 3 a.m. and pointed out that a sound barrier could not be put up in the <br />middle of Lorain Road. Mr. Nemeth who has been living on the property <br />agrees that there is a noise problem and has advised these tenants that <br />he may not extend their lease if they do not control their patrons. J. Thomas <br />moved to approve the combination and assembly of permanent parcels nos. <br />233-25-1 and 233-25-2 with the following conditions, that a deed restriction <br />be recorded that states that the back of the parcel which is zoned resi- <br />dential will always remain residential and that the owner of that parcel, <br />whether it be the current owner or any future_owner, maintain that back <br />portion as residential, and not request rezoning_to commercial or any <br />other use, seconded by R. Bowen. Roll.call on motion: Thomas, Bowen, Betts, <br />and Gorris, yes. Bierman, Morgan, and Traczyk, no. Motion carried. <br />Mr. Thomas suggested that Mr. Nemeth discuss the deed restriction with <br />the Law Department. <br />III. BUILDING DEPARTMENT REQUESTS: (Resumed) <br />5) Biskind Development Company, Great Northern Corporate Center <br />25000 Country Club Blvd. <br />Amendment to detailed development plan (Mixed Use District), i.e. addition <br />of a restaurant. Referred by Council May 3, 1989. <br />Mr. Mize, representing Biskind Development Company, pointed out that their <br />request is actually an amendment to their preliminary land use plan, not <br />to the detailed development plan as stated on the agenda. He further <br />explained that their original plan included office buildings, parking <br />structures, a recreation and fitness building, and hotels. This plan had <br />subsequently been amended to change the location of the hotel. At this <br />point in time they do not believe that they will be receiving rental rates <br />which will support structured parking and are proposing to construct a <br />free-standing, 7,000 square foot restaurant instead of one of the proposed <br />parking structures. He further advised that a second access drive, directly <br />onto Great Northern Boulevard, across from Sears, will be constructed with <br />this phase of the development as was stipulated at the time the hotel <br />received approval.
