PLANNING COMMISSION SEPTEMBER 26, 1989 PAGE 2 <br />The club has agreed to landscape and maintain the property adjoining <br />the sign, but Mr Yuich stated that the City of North Olmsted will main- <br />tain the right of way as it does at this time. He further explained <br />that they would carry insurance coverage on the sign and the adjoining <br />landscaping. Assistant Law Director Dubelko advised that some sort of <br />license agreement should be drawn up spelling out the limits of their <br />usage of the property. Mr. Yuich agreed that their attorne.ys would <br />draw up whatever papers are necessary. Mr. Halpin advised that Westlake <br />merely granted them a temporary easement to go onto the pronerty to <br />erect the sign which is located at the Westlake entrance. Mro Thomas <br />pointed out that this would be a different situation since they are <br />residents of Westlake. He also suggested that some sort of condition <br />should be included so that neither the City of North Olmsted nor its <br />employees be liable if any damage might occur to the sign or landscaping <br />while the city was maintaining their portion of the property. T. Morgan <br />moved to approve the Woodpath Development Sign, located on City of North <br />Olmsted property on Gessner Road provided that they prepare a legal : <br />license which would outline the city's liabilities and anything pertinent <br />to the protection of the City of North Olmsted for granting of said lic- <br />ense, which must be reviewed by the North Olmsted Law Department, seconded <br />by R. Bierman, and unanimously approvedo After some discussion, it was <br />decided that since the BZD meeting was scheduled for the next evening, <br />there would not be sufficient time for the Law Department to review the <br />document and this would have to be heard by the BZD at their next meeting. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1), Paradise Honda Automobile Agency, 25892 Lorain Road <br />Revision to originally approved plans. (Approved by Planning Commission <br />April 25, 1989). <br />Heard by the Architectural Board of Review September 20, 1989. <br />Mr. Schill, architect, presented an ?ssembly plat which had been requested <br />at the last meeting. The plat had not been presented.previously to the <br />Engineering Department, nor is it on the agenda. In reference to the <br />building proposal, Mr. Schill explained that Mr. Paradise has opted for <br />a solid colored building, he will not be using the accent color as <br />suggested by the Architectural Board of Review, r1r. D4organ questioned if <br />the cross easement for parking would be necessary for approval of the <br />building plans. Assistant Law Director Dubelko advised that this docu- <br />ment would not have to be submitted at this time, but approval should be <br />contingent upon such a document being submitted and that the Law Depart- <br />ment can review to ascertain that it is satisfactory but this should be <br />a matter of record before they start building. M. Betts moved to approve <br />the proposal for Paradise Honda at 25892 Lorain Road subject to the pro- <br />vision that the building be one solid color as stipulated in the <br />Architectural Board of Review minutes of September 20th, and that some <br />documentation be provided that demonstrates the existence of a cross <br />easement for parking purposes as stipulated in our minutes of September 12th; <br />seconded by J. Thomas, and unanimously approved. The Commission studied <br />the lot split and assembly. Mr. Bierman stated that it would be irreg- <br />ular to vote on this since it is not an agenda item. Mr. Morgan pointed <br />out that one lot is only 110 feet wide and would not conform to the code. <br />Since this one parcel would be non-conforming, Mr: Dubelko advised that, <br />even though this parcel is less non-conforming than the original parcels, <br />the pzaposal should be forwarded to the Board of Zoning Appleas because <br />there would be enough land here to create a legal lot.
