. ? <br />CITX OF NORTH OZMSTED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES - JANUARY 26, 1989 <br />I. ROLL CALL: <br />Chairman Kazak called the meeting to order at 7:30 p.m. <br />Present: J. Kazak, J. Konold, and D. Spoerke Absent: R. Burk and B. Schulz <br />Also Present: Building Commissioner Conway and Clerk of Commissions Oring.. <br />II. REVIEW AND CORRECTTON OF MINUTES: <br />Motion on page 1, under New Business in the ninutes of November 17, 1988 was <br />corrected to read: "R. Burke moved to adopt the 1989 OBBC based on the 1987 <br />BOCA code,..." J. Konold moved to accept the minutes of November 17, 1988' <br />as' corrected, seconded by D. Spoerke, and unanimously approved. <br />III. COMMiJNICATIONS: <br />No items. <br />IV. HEARINGS: <br />Chairman Kazak advised the applicants that there were only three members <br />present at the meeting and since it takes three affirmative votes to approve <br />a request, either applicant may withdraw his request until the following <br />month if he so desires. If an applicant chooses'to be heard under those <br />circumstances, any decision will be final. Building Commissioner Conway <br />advised that any appeal from a decision would have to be through the courts. <br />Both applicants chose to be heard. <br />Chairman Kazak administered the oath to all persons present f.or both hearings: <br />Wayne Palmer, Warren Palmer, Richard Exner and P.ichard Myers. <br />Chairman Kazak advised that item number 2 would be heard first. <br />2) Richard Exner, property located between 23089 and 23059 MacBeth. <br />Request permission to construct dwelling on permanent parcel 237-13-49 <br />MacBeth Ave. ("C" District, minimum lot frontage 60 feet). Hearing required <br />by Ord. 2806 (any house being built on a lot with a 50 foot front width or <br />less requires the approval of the Board of Building Code Appeals). (Variance <br />will be required from the Board of Zoning Appeals). <br />(This hearing was rescheduled from January 12, 1989). <br />Mr. Exner explained that when these lots were originally set up, most of them <br />were the same width as this one and that he has tried to find a house that is <br />compatible with others on the street. Building Commissioner Conway advised <br />that a variance from the Board of Zoning Appeals would be necessary because <br />the house will be 125 square feet less than required and also Mr. Exner will <br />be asking to delay builc?ing a garage until one year after occupancy of the <br />house. Mr. Kazak stated that he had been on the property and believes that <br />this house will fit in with the rest in the neighborhood and pointed out that <br />there are oi.her lots on the street that are the same width. Mr. Exner ex- <br />plained to Mr. Myers, the next door neighbor, that the plans shown would be <br />reversed and the house would be a mirror image of what is presented. Mr. Myers
