,- -JP <br />BOARD OF BUILDI,NG CODE AFPEALS JANUARX 26, 1989 PAGE 2 <br />has several concerns; where the house wi11 be located in relation to the houses <br />on either side; the grade difference in the lots since his property is higher <br />than this 1ot; if.the trees on the property wi11 be removed; and pointed out <br />that he found a pipe which he thinks is a gas line in his back yard. He was <br />advised that this house will have a conforming, SO foot front set back, that <br />the drainage wi11 be checked by the city? that one of the two trees would have <br />to be removedy that Mr. Exner will have a driveway installed at the time the <br />house is constructed even ifbe,gets permission to delay the construction <br />of the garage. Mrt Myers stated that he had been told by someone in the city <br />(he thought it was someone from the Building Department) that this 45 foot <br />lot was not buildable. He had wanted to buy the lot, but was waiting for <br />the price to come down. Mr. Kazak advised that since the lot was subdivided <br />prior to the ordinances, the owner has a right to develop,, it. Building <br />Commissioner Conway advised that this Board looks at the impact of developing <br />these lots from the standpoint of drainage and the code allows property owners <br />to build on a non-.conforming lot providing Zoning Code requirements can be <br />met. Jt Konold moved to grant permission to construct a dwelling on permanent <br />parcel 237-13,49 MacBeth Ave, seconded by D.. Spoerke, and unanimously approved. <br />1) Wayne Palmer, 6145 Fitch Road <br />Request variance from Section R 24 CABO One and Two Family Dwelling Code <br />which requires wzdth of sta3rway to be 36 inches (30 inch basement stairway <br />already constructed). (Hearing rescheduled from January 12, 1989). <br />Warren Palmer stated that when the prints were submitted, they were not advised <br />that the stairway was too narrow and that moving the wall would be a hardship <br />since the wall and stairway are completed. He stated that there was a 32 inch <br />opening and there would be no problem moving appliances downstairs. Building <br />Commissioner Conway advised that the 3 foot 7 inch dimension shown was based <br />on a poured concrete foundation, but they used a 12 inch block foundation <br />instead. Mr. Kazak stated that he was in the house and does not believe <br />there would be a problem widening the opening, but there would be some ad- <br />ditional expense. The members agreed that the narrow stairway could cause <br />problems in the future especially in the event of re-sale. Mr. Palmer agreed <br />that he could make the change. J. Konold moved to deny the request of Tdayne <br />Palmer for a variance from Section R-24 CABO One and Two Family Dwelling Code <br />for the width o£ a stairway, seconded by D.
