The oath was <br />administered to Mr. Leech, Brilliant Electric Signs, who explained that the re- <br />quest is for a neon sign to be placed in the window as they do in their other <br />locations. He explained that the sign was installed because they did not know <br />that a permit was required for a window sign in North Olmsted. J. Helon moved <br />to grant the variance for Mayridge Podiatry at 4579 Great Northern Boulevard <br />for a 13.38 square foot variance for total sign area to install a window sign, <br />seconded by T. Restifo, and unanimously approved. Variance granted. <br />3. Mark Pirtle, 5096 Whitethorn Ave. <br />Request for variance (1123.12). Request variance to have 4 foot fence (existing) <br />around a yard with a swimming pool (6 foot fence required around pool). Violation <br />of Ord. 87-93, Section 1135.02-L. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Pirtle who explained that the pool was existing when he <br />moved in and that since he was replacing an existing 4 foot fence, he was told <br />by the Building Department that he did not need a 6 foot fence. Originall_y he <br />was going to put a 6 foot fence around the pool area but changed his mind. Mr. <br />Conway explained that since there was no record of a permit for the original <br />fence or pool, it had been determined that he would have to conform to the ordi- <br />nance. Law Director Gareau stated that if the original structure deteriorated <br />to the extent of 50% it looses it non-conforming status and a new structure <br />must conform. Since the fence has been installed the Board has a problem with <br />making him remove it especially because he has replaced an existing fence. <br />B. Grace moved to grant the request for a variance to have a 4 foot fence around <br />a yard with a swimming pool for Mr. Mark Pirtle, 5096 Whitethorn Avenue, <br />seconded by T. Restifo, and unanimously approved. Variance granted. <br />4. Olmsted Manor Assisted Living Facility, 27500 Mill Road <br />Request for variance (1123.12). Request 15 foot front set baek variance; <br />request 15 foot rear set back variance. Violation of Ord. 87-93, Section <br />1139.04(a) and 1139.05(c)-1. Also request 22 foot varianee for location of <br />loading zone from residential property and variance to have 1 less loading zone <br />than required. Violations of Ord. 87-93, Section 1161:12(b) and 1161.12(e). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Ms. Lonter, administratior of Olmsted Manor Nursing Home; and <br />Mr. Draeger and AZr. Suhayda, architects, who explained that they had received a <br />variance for the addition to the adjacent Olmsted Pianor Skilled Nursing Facility <br />and have now purchased the property next door where they would like to build this <br />structure for an assisted living facility. There would be 86 units; 46 one.bed- <br />room, 22 two bedroom and 18 efficiency units. Ms Lonter explained that this is - <br />different from a nursing home in that these people can live independently with <br />assistance. Law Director Gareau explained that he had ruled that this is <br />different from multi-family on the basis that this is a step down from a nursing <br />home. The developers explained that since the property is zoned General Retail, <br />two loading zones are required, but this type facility would only need one. <br />Building Commissioner Conway advised that they are required to provide 51 park- <br />ing spaces and are showing 57 on the plan. Mr. Grace believed that some of the <br />rear parking would be blocked if a tractor trailer were in the loading zone. In <br />response to the Board's questions, they advised that only 5 or 6 residents would <br />have a car. Mr. Gareau suggested that they landbank the 13 front parking spaces <br />and landscape the 35 foot front set back. It was then determined that they would
