In refer- <br />ence to the rear yard variance, it was explained that this property backs up <br />to the rear yard of the church which faces Dover Center Road. B. Grace moved <br />to grant the variances for the Olmsted Manor Assisted Living Facility at 27500 <br />Mill Road as follows: a 15 foot front set back variance and a 15 foot rear set <br />back variance contingent upon the landbanking of the 13 front spaces with land- <br />scaping taking their place and a variance for 9 less parking spaces (including <br />the two in the rear parking area) and also contingent on the entrance to the <br />property remaining as planned (a combined drive with the nursing home):. a 22 <br />foot variance for the location of the loading zone; and a variance to have one <br />less loading zoned than required, seconded by T. Restifo, and unanimously <br />approved. Variances granted. <br />5. Robert Warner, 2992 Clague Rd. <br />Request for variance (1123.12). Request 6 foot front set back varianee to <br />-replace existing sunroom with room addition. Violation of Ord._ 87-93, Section <br />1135.06-(a). Also request special permit to add to non-conforming dwelling. <br />Special permission required Ord. 87-93, Section 1164.02. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. and P1r. Warner and Mr. Rudiger, B. R. Able Company, who <br />explained that this addition will replace the existing sunroom and maintain <br />the original set back. T. Restifo moved to grant the request for a 6 foot <br />front set back variance to replace the existing sunroom with a room addition <br />and a special permit to add to a non-cofnorming dwelling, seconded by B. Grace, <br />' and unanimously approved. Variance granted. <br />6. Hennie Homes, sublot 51, 5502 Quail Run <br />Request for variance (1123.12). Request 3 foot side yard set back on corner <br />lot. Violation of Orde 87-93, Section 1135.06(b). <br />Chairman Bugala called all interested partie <br />administered to Mr. Welke, Hennie Homes, who <br />their standard models and on this corner lot <br />Helon moved to gran.t to Hennie Homes, subl.ot <br />side yard set back variance on a corner lot, <br />unanimously approved. Variance granted. <br />s before the Board: The oath was <br />explained that this is one of <br />it does require a variance. J. <br />51, 5502 Quail Run, a 3 foot <br />seconded by T. Restifo, and <br />7. DiBenedetto Subdivision, located on the north side of Brookpark Road Ext., <br />west of Hills Department Store. <br />Request for variance (1123.12). Request 45 foot rear yard variance (abutting <br />residential property) to construct retail building. Violation of Ord. 87-93, <br />Section 1139.05(c)-1. <br />Chairman Bugala called_all interested parties before the Board. The oath was <br />administered to D. DiBenedetto and T. DiBenedetto who explained that this <br />irregularly shaped lot has been rezoned to General Retail. They presented a <br />plan showing the small triangular area that would be buildable if they con- <br />formed to all set backs required'by code. D. DiBenedetto explained that the <br />house on the residential property to the rear of this building would be 160 <br />feet away and presented pictures showing that this area is completely wooded. <br />The Board members agreed that the property is being over developed. Law <br />Director Gareau suggested that an "L" shaped building might fit in better, <br />and also they might make arrangements to share an access with the Hills <br />Department Store. Mr. Gareau stated that since the Council approved the <br />rezoning, it would appear that they believe the property should be developed
