. <br />• BOARD OF ZONING APPEALS JANUARY 4, 1989 PAGE 5 <br />10. Olive Garden Restaurant, 25984 Lorain Road <br />Request for'variance (1123.12). Request variance to eliminate 3 additional <br />parking spaces in order to install second access. Violation.of Ord. 87-93, <br />Section 1161.05(r). (Previous variance granted for 9 spaces on March 2, 1988). <br />Chairman Bugala called all interested parties before the Board. The oath was- <br />administered,to J. Richards, General Mills Restaurants,and M. Mendez, manager, <br />who explained that their original proposal had a second drive, but at the <br />request of the Planning Commission, they eliminated it and re-arranged their <br />parking in order to have more green area in the front of the building. They <br />are now having problems with the one access and have received permission from <br />the City to use the non-dedicated drive from the recreation center to access <br />onto Lorain Road. Law Direetor Gareau advised that the City is negotiating <br />with the developer to use the drive with an agreement as to paving, lighting, <br />and maintenence. The Board is concerned about any liability to the city. <br />P4r. Bugala i:s concerned about any drive at this noint because of the drop in <br />the grade. Mr. Conway stated that the Engineering Department did not believe <br />this would be a problem and pointed out that the proposal would have to be <br />approved by the Planning Commission and the Engineering Department. Mr. <br />Restifo believed that there could be complaints from the residents using <br />the drive. Mr, Gareau suggested that they agree to eliminate the spaces <br />conditioned on the approval of Planning Commission and also that some satis- <br />factory agreement be reached with the City with respect to using City property. <br />Mr. Buagal pointed out that the dumpster on the property is taking up 3 parking <br />spaces. Mr.. Richards advised that this was done to eliminate taking out some <br />of the trees. B. Grace moved to approve the variance to eliminate 3 additional <br />parking spar_es in orde.r.to install a second access upon the approval of Planning <br />Commission and that a11 legal and other details be worked out with the Admin- <br />istration and City Council, seconded by J. Helon, and unanimously approved. <br />1.1. Pheasants Run Retail Center (Hennie Homes), 28867 Lorain Road. <br />Request for variance (.1123.12). Request 120 sq. ft. variance for temporary <br />leas3:ng sign. Violation of Ord. 87-93, Secti.on 1163.06(e)5. <br />Chairman Bugala called a11 interested parties before the Board. The oath was <br />admfnistered to Mr. Bartlebaugh, sign contractor, and Mr. We1ke, Hennie Homes, <br />who explained that the sign had been installed without permission and has <br />been removed. He explained that the temporary sign would be set back about <br />300 feet fram Lorain Road. Mr. Bugala questioned if the smaller sign in the <br />front and the small signs in the windows of the units would be removed. <br />Mr. Welke stated that the sign in the front would probably be taken down. <br />Building Commissioner Conway stated that the small signs in each unit are <br />inside the windows and he does not address those and that the leasing sign <br />in the front is under 40 square feet and can be used for up to 90 days. <br />J. Helon moved to grant the variance for Pheasants Run Retail Center (Hennie <br />Homes) at 28867 Lorain Road for a 120 square foot variance for a temporary <br />leasing sign to be installed for 6 months, seconded by T.
