BOARD OF ZONING APPEALS OCTOBER 4, 1989 PAGE 2 <br />has a concern about privacy and asked if the church could extend the fence; <br />he added that the church was a good neighbor. Mr. Rathbun is concerned ' <br />about noise. Mr. Fox questioned if this could cause any flooding and also <br />Il wondered if the structure would be in the way of relocated S.R.252. Mr. Pierson <br />advised that the structure would only be used during the day and only for the <br />same functions that they hold outside now. He further stated that there is a <br />storm sewer under the parking lot. He will have to take the request for the <br />additional fencing to the church board. R. Gomersall moved to grant the ex- <br />tension of the special permit to the North Olmsted Assembly of God Church, <br />3874 Columbia Road to construct a pavilion on church property, seconded by <br />J. Helon, and unanimously approved. Special permit granted. <br />3. Robert L. Storch, 4404 Martin Dr. <br />Request for variance (1123.12). Request 2 foot height variance for fence. <br />Please note: portion of fence will be varying heights from 6 foot 6 inches to <br />7 foot 3/4 inches in order to conform to grade of property. Violation of Ord. <br />87-93, Section 1135.02. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />II administered to.Mr. Storch who explained that he wanted to insure his privacy <br />? since his neighbors have put in a hot tub. He further explained that he is <br />? trying to buffer from noise as well, pointing out that the police have been <br />called three times recently because of noise. He maintains that, because his <br />property is 2 feet .lower .than ttreirs, :a 6 f-oot. fence would only give the <br />privacy of a 4 foot fence in this location. The members agreed that this <br />fence would be too high. J. Helon moved to grant the 2 foot height variance <br />and the variances for heights from 6 foot 6 inches to 7 foot 3/4 inches, .. <br />seconded by J. Helon. Roll call on motion: Helon, Gomersall, Grace, and <br />Bugala, no. Motion failed to pass. Variance denied. <br />4. Thomas R. Brenizer, 4348 Bentley Dr. <br />Request for variance (1123012). Request location variance for tool shed. <br />Violation of Orde 87-93, Section 1135.02-1. <br />Chairman Bugala called all interested parties before the Board. The.oath was <br />administered to Mr. Brenizer who explained that he wanted to construct the <br />tool shed in an area that was fenced in and screened with hedges which had <br />formerly been used for his dog. Members had no objection to the request. <br />R. Gomersall moved to grant the request of Mr. Thomas R. Brenizer, 4348 <br />Bentley Drive for a location variance for a tool shed, seconded by J. Helon, <br />and unanimously approved. Variance granted. <br />5. John Cotman, 5070 Hampton Dr. <br />Request for variance (1123.12). Request 188 sq. ft. variance for tool shed. <br />Please note: existing 192 sq. ft. detached workshop on property (also 9 feet <br />high). Violation of Ord. 87-93, Section 1135.02(d). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Cotman who explained that there was a 9 foot high, <br />work shop on the property which was built by the former owner with no variance <br />or permit. They are asking for a tool shed which will be 8 by 12 feet and only <br />8 feet high since they needed more storage area. B. Grace moved to grant the <br />188 s-4uare foot variance for a tool shed, noting that there is an existing 192 <br />v square foot detached workshop on the.property which is 9 feet high, for Johri <br />Cotman, 5070 Hampton Drive, seconded by J. Helon, and unan'imously approved. <br />Variance granted. _ <br />? <br />.
