e <br />1 <br />BOARD OF ZONING APPEALS OCTOBER 4, 1989 PAGE 6 <br />is wooded and would like to place the shed where it will be nestled into the <br />woods, beside his neighbors garage on one side (approximately 25 yards from <br />their property line) and it must be at least 50 yards from the other property <br />line (a creek and woods divide these properties). He maintained that this <br />is an attractive structure and he cannot put it in the rear since most of <br />his 3 acres is heavily wooded. Mrm Bowers, the neighbor to the south, stated <br />that he is opposed because the structure is too large, it might be used for <br />purposes other than a tool shed, and the location is not satisfactory. He <br />presented a letter of objection from his wife. Mr. Bowers could not say <br />what else the shed might be used for.._ Mr. and Mrs. Holmgren (the neighbors <br />closest to the shed) presented letters from other neighbors protesting the <br />variance and also a drawing showing the view as would be seen from their <br />house. Mr. Holmgren stated that they have no objection to the height or <br />size, only the location, advising that they would prefer that it be closer <br />ta their property line so it would be hidden from their view by their detached <br />garage..t-irs. Holmgren believed that if this variance is granted others in <br />the neighborhood would want their sheds moved up closer to their houses. She <br />further advised that the neighbors believe that the location of the shed <br />should be decided by the two neighbors on either side. They would like the <br />shed moved back 10 feet and placed 5 feet off their common property line. <br />Mr.. Michels thought that the proposed location would be hidden, but believed <br />the location suggested has some trees which would have to be removed and the <br />terrain in that area is rough. Mrs Holmgren disputed,this stating that there <br />is an old driveway at that point. The members-ha.ve no problem with the height <br />or size of shed considering the size of the lot, and suggested that the <br />proposal be tabled in order to work out a suitable location. 1.1r. Michels <br />stated that because he was to be hospitalized he could not have the issue <br />tabled. He agreed to move the shed over about 10 feet toward the Holmgren's <br />property line. After some discussion, it was determined that this was not <br />agreeable to the Holmgrens or Mr. Bowers., Law Director Gareau stated that <br />the location could be staked out and the Building Department could determine <br />if it would be visible from the Holmgrens' house, Mrs. Holmgren wants to <br />make sure that it would not be-seen from her deck as well. After some dis- <br />cussion and since the members really had no problem with the location and <br />no compromise could be reached, it was agreed to vote on.the variance as <br />requested. R. Bugala moved to grant the 20 square foot variance, the 1 foot <br />height variance, and the location variance for the tool shed for Mark and <br />Mary Kay Michel, 5717 Barton Road, seconded by B.
