Mrs. Sandy stated that <br />there was no mounding or buffering at this point between the houses and the <br />golf course. Mr. Sandy stated that they had to select house plans based on <br />the existing law, and does not believe that this is a hardship. R. Gomersall <br />moved to grant the request 10 foot rear yard variance for Mr. Andrew T. Senko, <br />S/L14 Sandpiper Lane, to construct a screened in porch, seconded by J. Helon. <br />Roll call on motion: Gomersall, Helon, Grace, and Bugala, no. Motion failed <br />to pass. Variance denied. <br />12. Joy Samourian, 6031 Louis Dr. <br />Request for variance (1123.12). Request-.variance to rent house and retain <br />apartment in dwelling for the owner in a single r.esidential district. <br />Violation of Ord. 87-93, Section 1135.02. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mrs. Samourian, Mr. Geiger, Mr. Haryey, Dr. Berthold, Mr. <br />Aquilla, and Mr. Aiorgan, all neighbors, Chairman Bugala advised that he had <br />received a letter from A. Schultz, 6003 Louis Drive objecting to the request, <br />as well as a.petition from 25 residents of Louis Drive and a note from Mr. and <br />Mrs. Hurley, all protesting the variance. Mrs. Samourian explained that since <br />she visits out of town frequently, she needs the renter to maintain the pro- <br />perty. If this variance is not granted she would have to move out of the <br />house and rent the whole house. Mr. Geiger suggested that Mrs. Samourian <br />sell the house since the renters she has had in the past are not desirable, <br />and she has been unable to control them even when she is living on the pro- <br />perty. Mr. Harvey and Mr. Aquilla agreed,stating that the rental property <br />is not good for the neighborhood and complaining of excessive noise, traffic, <br />vandalism, and litter. Dr. Berthold stated that he has known Mrs. Samorian <br />for many years and believes that only a small minority of renters have been <br />undesirable. He believes that she could get new renters who would be de- <br />sirable. Mrs. Samourian stated that she has given the present tenant until <br />the lOth of the month to move since he has not been a good tenant. Law <br />Director Gareau stated that this issue has been in the courts before because <br />she has.been operating a two family home.in a single family district. He <br />pointed out that if she moves out, she.can continue to rent the property as <br />a single family residence. He further stated that if this variance would be <br />granted, it would tie his hands in the future. R. Bugala moved to grant a <br />variance for Joy Samourian, 6031 Louise Drive, to rent house and retain an <br />apartment in this dwelling for the owner, in a single residential district, <br />seconded by B. Grace. Roll call on motion: Bugala, Grace, Gomersall, and <br />Helon; no. Motion failed to pass. Variance denied. <br />13. Mark and Mary Kay Michel, 5717 Barton Rd. <br />Request for variance (1123.12). Request 20 square foot variance, 1 foot <br />height v.ariance and location variance for tool shed. Violation of Ord. 87-93, <br />Section 1135.02(d). . <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Michel, and neighbors, Mr. and Mrs. Holmgren.and Mr. Bowers, <br />who are objecting to the variance. Mr. Michel stated that he is trying to <br />improve his property by storing all his equipment in one place, at present <br />he cannot get his cars into the garage. He has a deep yard, most of which
