. <br />? <br />BOARD OF ZONING APPEALS OCTOBER 4, 1989 PAGE 4 <br />or part of it and not request a variance. The members had seen the situation. <br />B. Grace moved to grant the 3.5 foot side yard variance and the 104 square <br />foot variance for garage area in order to construct an addition to an addtached <br />garage, seconded by R. Gomersall, and unanimously approved. Variance granted. <br />9. Lauren Properties Liminted Partnership, 24107 Lorain Road <br />Request for variance (1123.12). Request variance to have 12 parking spaces <br />less than required, 3 of the above spaces are to be used for the location of <br />-a propane tank. Violation of Ord. 87-93, Section 1161.04 and 1161.03. Please <br />' note: this request would not be in addition to the 19 spaces previously <br />?granted, but would, in fact,reduce that variance by 7 spaces. <br />.. Building Commissioner Conway advised that this proposal was withdrawn from <br />the agenda because the developer had the property re-surveyed and there is <br />an area in which they can place the propane tank without using the parking <br />spaces. <br />10. Donald and Judith Herman, 25050 Lorain Road <br />Request for variance (1123.12). Request variance to use drive locat.ed in a <br />Mixed Use District as access from a home converted to a General Retail Use <br />(in a General Retail District). Violation of Ord. 87-93, Section 1139.08. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr, and Mrse Herman. Chairman Bugala stated that he is con- <br />cerned about adding another commercial use to this driveway, pointing out <br />that these owners are not the sole users of the drive. Mr, and Mrs. Herman <br />explained that their property is zoned General Retail and they plan to sell <br />their house for.an office use. They further stated that their property is <br />surrounded on three sides by commercial development and cannot be sold as a <br />residence. Law Director Gareau advised that about 15 years ago he ruled <br />that a General Retail access could not go through a single family area, <br />and after problems with the Lauren Hills proposal, this section was modified <br />so that all drives for a oeneral retail use must be on property zoned for <br />General Retail. Building Commissioner Conway explained that the property <br />behind them was rezoned to Mixed.Use after their house was built arcd tlieir <br />easement had been filed. The members agreed that there was a hardship. <br />B. Grace moved to grant the variance for ponald and Judith Hermari, 25050 <br />Lorain Road, to use a drive.located in a Mixed Use Dristrict as access from <br />a home converted to a General Retail Use (in a General Retail District), <br />seconded by J. Helon, and unanimously approved. Variance granteda <br />11. Andrew T. Senko, S/L 14 Sandpiper Lane <br />Request for variance (1123.12). Request 10 foot rear yard variance to con- <br />struct screened-in roof on dwelling not yet constructed. Violation of Ord. <br />87-93, Section 1135.08(a). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />' administered to Mr. Senko, neighbors Mr, and Mrs. Sandy, and Mr. Reinke, <br />representing the North Olmsted Golf Course. Chairman Bugala noted that a <br />letter had been sent by Mr. Jones, a resident on sublot 12, objecting to the <br />request. Mr. Senko stated that this structure would be more like a solarium <br />than a screened porch and would be built at the same time as the house. <br />Mr. Reinke stated that the golf course is getting complaints from the residents, <br />most of whoia are 50 feet away,. a 40 foot rear yard would cause even more
