BOARD OF ZONING APPEALS MAY 3, 1989 PAGE 6 <br />Another neighbor stated that he is concerned that this would make their <br />existing drainage problems worse. The Grauels stated.that they had a letter <br />from a realtor stating that this addition would not devaluate the adjacent <br />propertyies, and advised that they had no intention of hurting the neighbor- <br />hood, and also stated that hanging up sheets would not duplicate their addi- <br />tion. Mr. Grace stated that the addition is beautiful, but it is too big <br />and way over what would ever be approved. Mrs. Grauel pointed out that their <br />lot is extremely wide. Mr. Grace and Mr. Gommersall both suggested that the <br />addition be built north and south instead of east and west. R. Gomersall <br />moved to grant the request of Loretta and Thomas Grauel, 5425 Dorothy Drive, <br />for a 32 foot rear yard variance, violation of Ord. 87-93, Section 1135.08(a), <br />seconded by J. Helon, Roll call on motion: Gomersall, Helon, Grace, and <br />Bugala, no. Motion failed to pass.. Variance denied. <br />15. Arthur A. Ally Subdivision, northeast corner of Mastick and Columbia Roads, <br />(24454 Mastick Road). <br />Request for variance (1123.12). Request 10 foot variance for depth of lot <br />(one property line less than 135 feet). Violation of Ord. 87-93, Section <br />1135.05-(a)3. Referred by Planning Commission April 25, 1989. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Al1y, Councilman and Mrs. McKay, Mrs. Senal, and Mr. and <br />Mrs. Kurz. Building Commissioner Conway advised that this proposal was ap- <br />proved by Planning Commission with the recommendation that the variance be <br />granted. Mr. Ally explained that there is a century house on the property <br />now which is to be renovated. Mr. Conway clarified that the house is on the <br />corner of Columbia and Mastick Road and either street can be considered the <br />front, the address has no bearing on what is the frontage. Councilman McKay <br />is concerned since if one of the other lots in this subdivision is developed, <br />a house could be built 5 feet from his rear property line. This lot does <br />not require the variance. A neighbor questioned if these lots were to be <br />subdivided again and was advised that they would have to conform to code, <br />R. Grace moved to approve the 10 foot variance for the depth of the lot (one <br />property line less than 135 feet), violation of Ord. 87-93, Section 1135,05-(a)3, <br />seconded by J. Helon, and unanimously approved. Variance granted. <br />16. Devco Homes, Inc. sublot 26, 24715 Tara.Lynn Drive <br />Request for variance (1123.12). Request 2.5 foot variance for distance <br />between dwellings. Violation of Ord. 87-93, Section 1135.07(a). <br />Chairman Bugala called all interested parties before the Board. He stated <br />that he objects that this request was added to the agenda after he was told <br />that it was too late. Mr. Conway advised that he was directed to put this. <br />on and was told that the Law Department had advised that if the developer <br />notified the abutting property owners himself the proposal could be heard. <br />At this point Chairman Bugala administered the oath to Mr. Debris, his <br />brother also Mro Devris, and Mr. Shear, all representing Devco Homes. They <br />explained that they had talked with the Mayor who advised that if they notified. <br />all the neighbors that there was going to be a meeting, that they could be <br />on this agenda. Mr. Devris did this on Saturday and none of the neighbors <br />had any objection. They explained that they had a contract to build a house <br />but if they waited for another month they would not be able to meet the <br />completion date9 and their buyer had sold his home. They explained that the <br />house next door was built too close to the property line and was in violation,
