BOARD OF ZONING APPEALS MARCH 1, 1989 PAGE 2 <br />stated that there were no small children in the neighborhood and their neighbors <br />agreed that the 2 foot fence on the top of the pool was not necessary. Mr. Grace <br />stated that this ordinance was created for their own safety. T. Restifo moved <br />to grant a variance to eliminate the 6 foot fence around the pool located at <br />29594 Josephine Drive for Walter W. Cox, seconded by B.•Grace. Roll call on <br />motion: Grace, Helon, Restifo, and Bugala, no. Motion failed to pass. <br />Variance deniedo <br />4. North Olmsted Lumber, 27375 Lorain Road <br />Request for variance (1123.12). Request variance to have gravel driveway. <br />Violation of Ord. 87-93, Section 1161.10-a. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Nesselhauf, General Manager of North Olmsted Lumber, who <br />explained that the wanted the gravel area for over flow storage. This area is <br />at the rear of the property and is just dirt now, there has been vandalism and <br />they have been asked by the neighbors to clean it up. Mr. Grace asked if they <br />would be willing to oil it down so that dust would not be created. Mr. Nesselhauf <br />agreed to that and stated that a previous request that had been approved had <br />not been built because the cost of putting in drainage and black top.had been <br />prohibitive. Law Director Gareau pointed out that the plans show a 6 foot fence <br />to match the existing city fence was to be installed and advised that if this <br />request is granted a stipulation be made that they maintain the fence, PZr. <br />Nesselhauf advised that the fence would be pressure treated wood which will be <br />stained. T. Restifo moved to grant a variance to.have a gravel driveway at <br />27375 Lorain Road, North Olmsted Lumber, with the stipulation that the fence <br />which is to be installed will be maintained by North Olmsted Lumber Company, <br />seconded by J. Helon. Roll call on motion: Restifo, Helon, and Bugala, no. <br />Mr. Grace, yes. Motion failed to pass. Variance denied.(See discussion at end <br />of ineeting). - <br />5. Aquasonic Car Wash, 28800 Lorain Road <br />Request for variance (1123.12). Request 6 foot front set back variance for <br />canopy and 2 foot front set back variance for corner of building (vestibule). <br />Violation of Ord. 87-93, Section 1139.04. Please note: building under . <br />construction. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. J. Attwood, owner, who presented the site plan which was <br />used to lay out the building. He pointed out the 90 foot dimension which had <br />been picked up as the set back, but that 90 foot figure was not from the pro- <br />perty line, it was from the 7 foot green area. The work was done in October, <br />but they were not told about the error until February 18th. He pointed out <br />that they had originally designed the canopy in an irregular ma.nner so that it <br />would conform to the 50 foot set back and that since the property is 700 feet <br />deep there would have been no problem conforming to set back requirements. -He <br />stated that this was just a mistake, and was not done maliciously. He further <br />advised that there was just one corner of the vestibule of the building that <br />was encroaching, but the canopy is out further; it will be impossible to tear <br />out the vestibule, since there are footers and a supporting wall. Also the <br />canopy was designed to have the superstructure imbedded into.the wall of the <br />building and because of the footers and the tank field behind the canopy it <br />would be impossible to change it at this point. He stated that aesthetically <br />this should not effect Lorain Road since there are other non-conforming front <br />set backs in the area. He presented a list of non-conforming set backs in an <br />area from Dover Center Road to Barton Road showing that out of the 47 properties
