- :
BOARD OF ZONING APPEALS MARCH 1, 1989 PAGE 3
measured, 26 were non-conforming. He also stated that there were 3 canopies in
this area and none of them had a conforming set back. He further advised that
his building was about 95% completed. Regarding the other non-conforming
set backs, Mr. Bugala stated that the Board did not know the history on all of
them and that there was no way to know that the measurements were correct.
Mr. Grace pointed out that a variance for a canopy on one of the gas stations
in the area was denied previously and suggested that the builder should rectify
this mistake. Mr. Attwood explained that the person who laid this out was his
construction supervisor, who is his employee. Law Director Gareau suggested
that they could have a variable set back in whieh the first 35 feet, excluding
the driveways, is green area. Mr. Attwood explained that this area has been
paved and is used to store the cars until the customers can get to them.
Board studied the plans and.suggested cutting the canopy back. Mr. Gareau
pointed out that the Board should know how this is going to look before ap-
proving it. Mr. Attwood questioned if he could start operating before this is
approved, since he would have to wait a month. Mr. Gareau again suggested that
they consider the 35 foot green area and'hold this request until the end of the
meeting. Mr. Bugala stated that he has no objection to the variance for the
vestibule. The Board discussed cutting the canopy back to the supports., Mr.
Conway advised that there would be approximately 30 inches from the edge of the
canopy to the supports. Mr. Bugala and Mr. Restifo agreed that just taking off
two feet would not be worth the expense. Mrs. Pierson, a resident who lives
across Lorain.Road, stated that this is a nice looking building and she is
concerned that if they have to cut some of it off, it would ruin the appearance.
Mr. Grace does not think it would change the appearance, and beleives that since
the Board has denied other canopy variances, that they must be fair. Mr. Bugala
pointed out that variance for canopies have been granted as well. J. Hel:on
moved to grant the variance for Aquasonic Car Wash at 28800 Lorain Road for a
6 foot front set back for a canopy and a 2 foot front set back for a corner of
the building, seconded by B. Grace.. Roll call on motion: Helon, Restifo, and_
Bugala, yes. Nir. Grace, no. Motion carried. Variances granted.
6. Steve Hanobik, 7000 Barton Road
Request for variance (1123.12). Request 149 square foot variance to keep
existing detached garage (building permit issued for second detached garage
which is already constructed). Violation of Ord. 87??93, Section 1135.02.
Chairman Bugala called all interested parties before the Board. The oath was
administered to Mr. Hanobik who explained that he built a new garage and
was going to tear down the existing garage since he did not know that he
could request a variance to keep it. He has painted and repaired the old
garage and would like to keep it to store his equipment. Mr. J. McLaughlin, a
neighbor, came forward at this time and was sworn in and stated that this
house is very small and has no basement. He believes that it would be a
shame if Mr. Hanobik had to remove the garage. Mr. Grace pointed out that
Mr. Hanobik had made many improvements to his property. B. Grace moved to
grant a.149 square foot variance to keep an existing detached garage for
Steve Hanobik, 7000 Barton Road, seconded by J. Helon, and unanimously
approved. Variance granted.
7. Great Northern Retail Campus
Request a re-hearing of conditions imposed on variance granted by the Board of
Zoning Appeals on February 1, 1989.
Chairman Bugala called all interested parties before the Board.
