?i <br />. } <br />PLANNING COMMISSION FEBRUARY 27, 1990 PAGE 4 <br />opposed to any rezoning, they want the area to remain residential, and <br />would like to see what definite plans that the developer has. Mr. Thomas <br />pointed out that the City would like to maintain some control.over this <br />property and does not want to have the courts determine how the area is to <br />be developed as previously happened on the Developer Diversified property; <br />pointing out that this developer would have a strong case to rezone through <br />the courts. He suggested that maybe the adjacent homes would not maintain <br />value as homes, maybe they would retain value in another use. Assistant <br />Law Director Dubelko pointed out that in the case of a split zoned lot, <br />it is not alway necessary to rezone to one of the two present zonings, it <br />would b.e within the city's autliority to rezone to a totally different use; <br />however, this is not his s.uggestion, merely a clarification. In reference <br />to the neighbors request to see definite plans, Mr. Mize, Biskind.Develop- <br />ment Company, explained that they are working with several build-to-suit. <br />office tenants, and could not say definitely what the buildings would be, <br />quite possibly a four story office building. Neighbors are definitely <br />opposed to such a high building. Mr. Bierman questioned how the neighbors <br />would feel about the off ramp which could possibly take two residential . <br />lots and leave one or two lot's between the ramp and the, highway. Mr. Lamneck <br />pointed out the ramp is not definite and should not be considered with this <br />rezoning. Mro Thomas advised the residents that these issues-would be <br />discussed.at the March 13th Planning Commission meeting, that there would <br />be a committee meeting at 7:00 p.m. which they may attend, but since this <br />would be a study meeting, they would not be invited to speak. Mr. Lamneck <br />advised that this developer also owned property on the east side of Columbia <br />Road next door to him. J. Thomas moved to table this proposal until the <br />March 13th meeting at.whieh time we can discuss thefindings of our meeting <br />with Mr. Hill regarding this area in more detail allowing public discussion <br />and comments from the audience and the developer, seconded.by R. Bowen, and <br />unanimously approved. The neighbors were advised that the maps presen:ted <br />this evening would be available in the Engineering Department and-that they <br />could also 'study the Zoning Code there which would explain the possible <br />uses of the Mixed Use District. <br />V. CON1IIJNICATIONS: <br />A copy of a letter from John J. Duffy, attorney, concerning Kings Path Condo- <br />minium's objections to the Home Centers proposal regarding parking, drainage, <br />and security which was given to City Engineer McDermott. <br />VI. COMMITTEE REPORTS: <br />No items. <br />VII. NEW BUSINESS: <br />No items. <br />VIII, OLD BUSINESS: <br />No itemso <br />IX. ADJOURNMENT: <br />J.
