ROLL CALL: <br />Chairman Thomas called the meeting to order at 8:10 p.m. <br />He welcomed 14r. Orlowski, a new member, to the Commission <br />Present: R. Bierman, M. Betts, B. Gorris, T. Plorgan, L. Orlowski, and <br />J. Thomas. <br />Absent: R. Bowen <br />Also Present: Assistant Law Director Diibelko, Building Commissioner Conway <br />Assistant City Engineer McDermott, and Clerk of Commissions <br />Oring. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />Deferred until later in the meeting. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1) Darby 0`Toole's, 24280 Lorain Road <br />Exterior renovation'to building. <br />Heard by Architectural Board of Review:.March 21, 1990, <br />Mr. Kelly,owner, presented plans and advised that he had,no problem with <br />the Architectural Board's recommendations and that the owner of the <br />property, Mr. Murton, was present as requested. Chairman Thomas stated <br />that there was some problems with a few items mentioned at the last <br />meeting: trash, debris, and the base of an old light pole on the property; <br />that the access to the house on the rear of the property could be blocked; <br />the practice of some patrons parking across the street;and that the number <br />of parking spaces does not conform to code. Mr. Kelly responded that <br />they had removed the trash even though it was not theirs; the base for <br />the abandoned pole will be,removed;.that they are required by lease to keep <br />the residential driveway open and there has be-en no problem with that at <br />all. He questioned why the parking should bean issue when they are just <br />restoring the front of the building, he has been told that they are 11 <br />parking spaces short, but was also told that in 1982 there were.223 seats <br />and at•this time they have been given an occupancy for 184. He pointed <br />out that this building has existed as a bar since 1982.with the same. <br />parking, and believed tnat a variance should not be necessary under these <br />conditions. Mr. Thomas stated that the city has never had a problem with <br />Darby 0'Toole's, but the ownership could change and that the.Commission <br />usually takes up these issues whenever a building comes before them in <br />an effort to correct existing problems.: Mr. Kelly pointed out that last <br />year (the first year they were open) they did have a problem on St.=Patrick's <br />Day, but this year they were able to handle it properly, and also that <br />now there are other shopping centers around with huge lots which they can <br />sometimes use for the overflow. The Commission agreed that parking could <br />not be based on what was needed for St. Patrick's Day. Mr. Kelly advised <br />that there was an area behind Rad-Air which Mr. Murton ownes and which <br />. they could use for the 11 spaces. Building Commissioner Conway stated
