• x_ <br />PLANNING COMMISSION MAY 8, 1990 PAGE 7 <br />V. COMMITTEE REPORTS: <br />Mr. Thomas explained that t4re Hill, City Planner, has written a new definition <br />of the Mixed Use District which includes "A", "B", and "C" classifications. <br />Mr. Thomas has some doubts about the Mixed Use "C" since it contained the <br />same uses as in Mixed Use "A" as well as hospitals, educational institutions, <br />and park administrative uses. Mr. Thomas has altered Mr. Hill's proposal by <br />eliminating Mixed Use 11C" and changed Mixed Use "B" to include some uses <br />that were in "C", and has left the "A" section as proposed. He is requesting <br />that the'Assistant Law Director, the Building Commissioner, and the members <br />review his suggestions and make their recommendations. This will be discussed <br />during the next regular meeting. After finalizing the uses, the CQmmission <br />would like the Law Department to write legislati-on to be presented to Council. <br />VI. COMMUNICATIONS: <br />No items. <br />VII. NEW BUSINESS: <br />No items. <br />VIII. OLD BUSINESS: <br />Lauren Hills Shopping Centera Mr. Thomas noted that there have been ongoing <br />problems with trucks unloading in the f ire lane at Lauren Hill Plaza and a <br />letter from Safety Director Gundy had requested a legal opinion as to whether <br />the fire lane could be closed off without being a liability to the City.. <br />Mr. Thomas stated that the fire lane is on residential property and is being <br />used as a service drive. Mr. Conway pointed out that the majority of the lane <br />is on commercial property, only the portion at the heel of the "L" is residen- <br />tial, but the developer did state that he was not going to use it to service <br />the back of the building. Assistant Law Director Dubelko did not agree that <br />the solution was to block off the lane, but it might be possible to work with <br />the developer to attempt to re-direct the truck traffic. If they repeatedly <br />violate the code a citation can be issued and they can be taken to court. <br />Mr. Conway questioned this since the area where they are unloading is commer-_ <br />cially zoned. He suggested that perhaps the Commission should look into the <br />requirement that loading zones have to be at the rear of the property. Mr. <br />Gorris thought that the developers should be forced to live up to what they <br />had agreed to at the Plannine Commission meeting. Mr. Dubelko believed that <br />this would be a violation of the Zoning Codes and suggested that if the Building <br />Department cannot get them to conform, the issue could be turned over to the <br />Law Department. He also stated that it is conceivable that the owners could <br />have gone to court and had the entire parcel re-zoned to commercial and it <br />could have been paved all the way to the rear property line with just a fence. <br />He noted that s,ince this was approved an ordinance has been passed prohibiting <br />fire lanes on residential property. The Law Department and.the Building <br />Department will keep the Commission informed. <br />IX, ADJOURNMENT: <br />B.
