Mr. <br />Dubelko stated that he was warning him that if he built on the <br />second vacant lot, he would not be able to build on the third <br />without a variance, and since he has the opportunity to make two <br />conforming lots at this time, the city would construe this as <br />creating his own hardship. It would appear that he could possibly <br />make 3 conforming lots. Some residents were present, but made no <br />comment. Mr. Thomas advised that there had been a telephone <br />message from Mr. Helms, who lives across the street, advising that <br />he was against the proposal since he does not believe the lot is of <br />sufficient size. Mr. Thomas pointed aut that the lot.did conform <br />to code. Ms Callahan assured the Commission that Mr. Hoefer was <br />aware of this hearing, and there was a purchase agreement. The <br />members are still concerned that Mr. Hoefer may not lmow what <br />is going on. Mr. Dubelko stated that there would not appear to be <br />a problem and the City could not be involved in that.. R. Bierman <br />moved to approve the proposal to move and re-align the property <br />line between permanent parcel nwnbers 237-24-9 and 237-25- 0 1, <br />located on the south side of Mastick Road, west of Park Lane, the <br />Edward Hoefer Subdivision, but it should be pointed out that with <br />this re-alignment there. will be a lot east of this re-alignment <br />that does not conform to the zoning code, and is owned by the same <br />party, so a self imposed hardship will., be -created and will <br />preclude the establishment of a building on a non-standard lot, <br />seconded by R. Bowen, and imanimously approved. <br />3) Deerfield Paxk Estates Location Sign. <br />The proposal is to install one (1) pole sign noting the name <br />"Deerfield Park" in the center roadway island of Deerfield Drive <br />immediately west of the Walter Road eritrance. <br />Mr. Thomas explained that this is to be a 10 foot tall pole sign on <br />a 6 by 6 foot treated post. Mr. J. Canty, contractor, presented <br />plans. Assistant City Engineer McDermott explained that the sign <br />would be located in the center island, of Deerfield Drive. _ <br />Assistant Law Director Dubelko advised that the homeowners <br />association would have. to enter into a licensing agreement to use <br />the land on which the sign was placed and would have to have <br />liability insurance to cover the city in the event of an accident. <br />An ordinance would then be drawn up allowing the placement of the <br />sign. Mr. Canty stated that he would have to take this information <br />back to the association, but pointed out that this sign would be <br />enhancing the property. Mr. Dubelko stated that one.time a driver <br />ran into a sigp and was injured, he consequently sued the city for <br />placing the sign in tYie right of way and won a judgement. Mr. Canty <br />explained that the association had also landscaped the island and <br />put in a tree and boulders. Mr. Ilubelko responded that they were <br />not supposed to put things in the right of way and advised that <br />they should carry about $500,000.00 in insurance. The members <br />agreed to approve the proposal contingent on procuring the <br />insurance and the license. J. Thomas moved to approve the proposal <br />to install a pole sign for Deerfield Park as inclicated in the plans <br />subject to the association.-getting.liability insurance according to <br />the Law Director's suggestions, seconded by R. Bierman, and <br />unanimously approved. <br />3
