i <br /> <br />CITY OF NORTH OLMSTED <br />BOARD OF.BUILDING CODE APPEALS <br />MINUTES - OCTOBER 25, 1990 <br />I. ROLL, CALL : <br />Chairman Burk called the meeting to order at 7:37 p.m. <br />Present: J. Konold, B. Schulz, D. Spoerke, J. Kazak, and R. Burk. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />Considering that the Frieg issue is being heard again this evening, Chairman <br />Burk read the minutes of August 23, 1990 when it was originally heard. J. <br />Kcnold moved to accept the minutes of August 23, 1990 as read, seconded by D. <br />Spoerke, and unanimously approved. <br />III. COMMUNICATIONS: <br />Letter from Mayor regarding expiration dates of some of the members. This <br />wi11 be discussed at the erxl of the meetingo <br />N. HEARINGS: <br />David Lusardo, property located between 23066. and 23108 Virginia Ave. <br />Request permission to cons.truct dwelling on permanent parcel 237-12-042 <br />Virginia Ave. ("C" District, minimum lot frontage 60 feet). Hearing required <br />by Ord. 2806 (any house being built on a lot with a 50 foot front width or <br />less requires the approval of the Board of Building Code Appeals, <br />Chairmazi Burk administered the -oath to Mr. Lusardo who explained that the <br />topographical survey, he pointed out- that a previous proposal for this lot was <br />was denied because of drainage. This is an old neighborhood and there are <br />drainage problems. He is proposing is a rear yard inlet basin with a six inch <br />outlet which will feed to the drainage ditch. in the tree lawn. The <br />Engineering Department advised that there is enough fall to drain properly. He <br />believes this will alleviate .some of the neighbors drainage problems. He <br />stated that, after a rain, there is standing water at the rear property lines, <br />but there is no water where the house is to be situated. Chairman Burk <br />administered the oath to R. Gardin and R Schaffer, adjacent property owners. <br />who pointed out that the driveway would be on the wrong side of the house. <br />Building Commissioner Conway advised that there is no right or wrong side for <br />a drivewaya Mr. Lusardo explained there'is a C.E.I. pole located right where <br />the driveway would be if it were on.the opposite side. Sidelines conform to <br />code. Mr. Schulz.is concerned that there is not enough fall for the drainage. <br />Mr. Lusardo has been talking to Mr. .McDermott, and Building Commissioner <br />Conway advised that the engineering Department would have to approve. Mr. <br />Schulz does not believe that this house is in keeping with the other homes in <br />the neighborhood. Mr. Lusardo explained that this is an older neighborhood <br />and with this size lot, it would not be feasible to build a detached garage <br />and does not believe that he should spend money to build a house that is the <br />type built 30 years ago. He has built similar houses previously in older <br />neighborhoods and they do blerxl in with the other houses. He is a contractor, <br />l.
