The Council can follow those guidelines or develop <br />their own guidelines. The Council's options would be to raze the struc- <br />ture.... Mr. Beaune interrupted saying what do you mean tear my house <br />down, don't talk crazy. I'll sue you and take youur house, etc. <br />Mr. Conway went on to say that Council also has the option of going with <br />the Board's recommendations and if the owner does not comply with the <br />order, they have the option to pay to have the repairs made and put a <br />lien on the*property. (Mr. Beaune was still muttering in the background). <br />Neighbors had no further questions. Mr. Copeland advised that his de- <br />partment has been working with Mr. Beaune for the past two years with <br />the faMily's intervention. This last time after the fire, they had <br />made a decision to have the police transport him for probate. riost <br />of the options that are available are on a voluntary compliance basis <br />by him which makes it difficult. They did have some prospective buyers <br />for the house, but that has not materialized. Metal chimney is not <br />enclosed as stipulated. <br />Chairman Burk administered the oath to Mr. Cook, Hillcrest Hones, but <br />there was no representative from-Chand Construction Company. Building <br />Commissioner Conway explained that there is a local ordinance.that <br />requires that any chimney, flue, or vent.must be coveredwith a metal <br />enclosure that simulates a conventional masonry chimney or with a <br />material that would match the house or siding, etc. Mr. Cook e:?Mlained <br />that in his case the chimney was not exactly in the valley as it was <br />in the Chand case, however the flue was too close to one of the ridges. <br />If a large simulated chimney were installed around it, it would look <br />worse-and be more visible than what is there now. He nointed out that <br />the flue can only be seen f.rom the golf course in the back of the <br />property;- but if it were enclosed it could be seen from the street. <br />He maintained that he could_install one and the cost would not be <br />prohibitive, but he does not believe that a simulated red brick chimney <br />would be in keeping with this tudor style home. Mr. and Mrs. Rice, <br />neighbo-rs, were sworn in at this-time-and-advised that-they-had attended <br />the meeting because they thought .that it was because all the chimneys
