? <br />BOARD OF ZONING APPEALS <br />APRIL 4, 1990 PAGE 4 <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Roswurm and adjacent property owners, Dr. and <br />Mrs. Davis, who were interested in seeing the plans. Building Commissioner <br />Conway explained that they will be reconstructing the portion of the house <br />that burned and the front setback will be slightly closer to the street than <br />it was before and will be 2 feet further off the side property line. The <br />Davises had no objection. T. Restifo moved to grant the 96 foot front setback <br />variance and 14 foot variance for the distance between the house and garage, <br />to reconstruct portion of house dama.ged by fire, and the special permit to <br />add to a non-conforming dwelling, seconded by J. Helon, and unanimoualy <br />approved. Variance and special permit granted. <br />11. Transohio Savings Bank, 25900 Country Club Blvd. <br />Request for variance (1123.12). Request location variance for pole sign al- <br />ready installed (1 foot, 9 inch encroachment into setback). Violation of <br />Ord. 87-93, Section 1163o06(f)4. <br />Chairman Bugala advised that the representative of the sign could not be <br />present. He stated that he had viewed the site and pointed out that this <br />is a major encroachment. Mr. Grace stated that this company has been before <br />the Board on many occassions and should know the ordinances. Mr. Bugala <br />questioned if a sign could be put over a parking space, because if it?-is__ <br />moved to a conforming location, it would be over a parking space. Building <br />Commissioner Conway responded that there is a stipulation.that a sign cannot <br />be over vehicular traffic, but this would be to prevent trucks from damaging <br />the sign, a parking space for a car would not create this problem. He ad- <br />vised t'nat when the contractor made application for the permit, the site <br />plan showed that the sign would be in compliance to the code, but it was <br />not installed as shown. Members agreed that the contractors should know <br />where signs are to be installed. J. Helon moved to grant the variance for <br />Transohio Savings Bank at 25900 Country Club Boulevard for a location vari- <br />ance for a pole sign already installed (1 foot, 9 inch encroachment into <br />setback), seconded by B. Grace. Roll ca•11 on motion: Helon, Grace, Restifo <br />and Bugala, no. Motion failed to pass.
