??.. ? <br />r <br />r BOARD OF ZONING APPEALS A.pRIL 4, 1990 PAGE 3 <br />who mainly wanted to see the plans. It was explained that the addition <br />would be set at the same building line as the existing house and the side <br />yards would be conforming. They had no objection to the proposal.. B. Grace <br />moved to approve the request for a 24.63 foot front setback variance and <br />the special permit to add to a non-conforming dwelling for David J. Dietz, <br />4570 Martin Drive, seconded by T. Restifo, and unanimously approved. <br />Variance granted. <br />7. Alex Vary, 5845 Park Ridge Drive <br />Request for variance (1123.12). Request 5 foot rear yard variance for patio <br />awning. Violation of Ord. 87-93, Section 1135.08(a). <br />r <br />/ Chairman Bugala called all interested parties before the Board. The oath was <br />U administered to Mrs. Vary. Members had no problem with the request. T. Restifo <br />moved to grant the 5 foot rear yard variance for a patio awning for Alex Vary, <br />5845 Park Ridge Drive, seconded by J. Helon, and unanimously approved. <br />Variance granted. <br />8. Ida Juhasz, 4881 North Porter <br />Request for variance (1123.12). Request 92 square foot variance, 2 foot <br />height variance, and location variance for tool shed (to replace existing <br />shed which was damaged by fire).-- Violation of Ord. 87-93, Section 1135.02(d)1. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mrs. Juhasz, and B. & P. Juhasz. They explained that the <br />remainder of the original 2 story barn which burned will be torn down. This <br />shed is smaller and they will not be building anothe.r garage at this time. <br />J. Helon moved to grant the request of Ida Juhasz, 4881 North Porter Road <br />for a 92 square foot variance, a 2 foot height variance, and a location vari- <br />ance for a tool shed, seconded by B. Grace, and unanimously approved. Variance <br />granted. <br />9. Ann Silvaggi, 4421 Danberry Drive <br />Request for variance (1123.12). Request 23 foot rear yard variance to construct <br />pat.io enclosure. Violation of.Ord. 87-93, Section 1135.08 (a). <br />Chairman Bugala called all interested parties before the Board.. The oath was <br />administered to Mr. Powell, contractor. Mr. Bugala stated that this would <br />be rather tight. Mr. Powell explained that there was aln existing slab with <br />an awning in the same location. Mr. Grace pointed out that the house does <br />not meet either the side yard codes or the rear yard codes. The members are <br />concerned that. this is too great an encroachment. B. Grace moved to grant <br />the request for a 23 foot rear yard variance to construct a patio enclosure <br />for Ann Silvaggi, 4421 Danberry Drive, seconded by J. Helon. Roll call on <br />motion: Grace, Helon, Restifo, and Bugala, no. Motion failed to pass. Vari- <br />ance denied. <br />10. Robert and June Roswurm, 30728 Lorain Road <br />Request for variance (1123.12). Request 96 foot front setback variance and <br />14 foot variance between house and garage to reconstr.uct portion of house <br />damaged by fire. Violation of Ord. 87-93, Section 1135.06(a) and 1135.02(c)1. <br />Also request special permit to add to non-conforming dwelling. Special <br />permission required Ord. 87-93, Section 1165.02.
