added on the north. An existing garage on the property and two trees will be <br />removed. They need a 10 foot set back variance on Mill Road. Mr. Bugala advised <br />that the forester had reported that he had no objection to the removal of the <br />trees. No neighbors were present. Mr. Bugala c.larified that it had been <br />determined that Mill Road was not a side street and this_ building would have. to <br />have a.50 foot set back on both Mill and Dover Center and the building is <br />non-conforming. The members had no problem with the addition, and Mr. Bugala <br />stated this would not infringe on the current set back. R. Gomersall moved to <br />grant the request of Suburban Auto Body, 4960 Dover Center Road, for a 10 foot set <br />back variance on Mill Road and and also to grant a special permit to add to a <br />non-conforming building, seconded by T. Restifo, and Lmanimously approved. <br />Variances granted. <br />2. Marathon Petroleum Company, 27645 Lorain Rd. . <br />Request for variance (1123.12). Request 37.67 sq. ft. variance for one'side of <br />of face for replacement pole sign; request location variance for pole sign; <br />request variance to have 3 pole signs on.property; and request 375.8 sq. ft. <br />variance for total sign area for all signs on property (including the replacement. <br />pole sign. Violations of Ord. 87-93, Sections 1163.06(f)-4; and 1163.06(d).. <br />Chairman Bugala ca,lled all interested parties before the Board. The oath was <br />administered to Mra Kacirek, owner, and Ms. Eyer, Marathon Petroletnn Company <br />Building Comnissioner Conway clarified that there are signs on some existi:ng.light <br />poles, which must be considered as pole signs. Mr. Kacirek stated that one of <br />sign would be removed. Mr. Gomersall questioned what variance would be required <br />if. all three existing pole signs were removed. Mr. Conway stated• that the two <br />signs are 96 square feetm. Mr. Restifb clarified that orily the sign would have to <br />be .removed from the light pole, not the polea They would still need.a.variance <br />for this sign. Mr. Ka.cirek offered to remove the ground sign. Mr. Conway stated <br />that if the information signs on the. pumps. were reduced to 4 square feet they <br />would not- have to be counted as sign area. It was suggested tha.t - return next <br />month with a new-plan showing exactly what-signs would be removed. Ms Eyer pointed <br />out that tYie Sheli station had a larger sign and that has set a precedent. Mr. <br />Bugala stated that each case is unique and no decision will set a precedent. - Mr. <br />Kacirek agreed to withdraw Lmtil next month. T. Restifo moved to.grant to.Marathon <br />Petroletmi at 27645 Lorain Road a postponement until the meeting_of November, 1990, <br />seconded by R..Gomersall, and tmanimously approved. Request postponed. <br />3. Mr..and Mrs. A. Novotny,.5126 Lucydale Ave. <br />Request for variance (1123.12). Request 2 foot variance from rear property..line <br />to construet..addition to garage (existirig garage is 3 foot. off rear property <br />line). Violation of Ord. 87-93, Section 1135.02-(c)1m - Chairman Bug$1a <br />administered: to <br />want to add : to <br />will maintain <br />Gomersall moued <br />Avenue for a 2 <br />to the,garage, <br />called all interested parties before.the Board. The oath was: <br />Mr. Novotny and Mr: Sindelar, contractor, who explained that they <br />the garage.which is 3 feet from the property Iine, the addition , <br />the same, setback. Members had no problem wi•th the request. R. <br />to grant the request to Mr. and Mrs. A. Novotny, 5126 Lucydale <br />foot variance from.the rear property line to construct an addition. <br />seconded T. Restifo,-and-unanimously approved. Variance granted. <br />4. Donald A. Kurth, 4075 Tennyson Lane. <br />•. Request forvariance (1123.12). Request.40 square foot variance and location <br />variance for tool shed. Violation of Ord. 87-93, Section 1135.02(d). <br />2
