Mr. Acciarri pointed out that they have met with the City'' s' t <br />traffic engineer several times, have made many revisions to the traffic <br />pattern and, considering that the Police and Fire Departments had no objections, he believed that they have addressed these concerns, and that <br />they have the best traffic pattern possible. Mr. Gorris agreed that the ' <br />developer has made an effort to alleviate the Commission's concerns, but if he <br />is dealing with a parcel that was previously created, he would deal with it <br />one way, but he has a problem with creating non-conforming parcels. Mr. <br />Acciarri stated that he believed that when this property was developed <br />originally, that this parcel was designated as an outlot and was intended to <br />be developed separately. Mr. Thomas is concerned that by allowing this <br />property to be subdivided, a precedent for creating other non-conforming <br />parcels would be set. Assistant Law Director Dubelko advised that since it is <br />possible that the Building Department was not aware that this was one parcel <br />they should look at the proposal again in that light prior to any approval. <br />Mr. Acciarri stated that the Building Department was aware that it was one <br />parcel. It was decided that, since the Board of Zoning Appeals would be <br />meeting after the next Planni:ng Commission meeting, and considering that the <br />lot split was not an the agenda., this proposal should be tabled tmtil the next <br />meeting after the Building Department had re-reviewed. J. Thomas moved to <br />table the discussion of the 1ot split for Carter Plaza West as well as the <br />development plans, until the Building Department has an opportunity to review <br />the situation, seconded by R. Bowen, and lmanimously approved. It was decided <br />that this proposal would be referred to the Board of Zoning Appeals for their <br />February 13th meeting with whatever recommendation the Commission will make on <br />February 12th. <br />2) Shell Oil Company, 23385 Lorain Road. <br />Proposal to construct food mart and new canopy on existing gas station site. <br />Heard,by Architectural Board of Review January 16, 1991. <br />No representative was present. Discussion of this proposal was deferred tmtil <br />later in the meeting. <br />3) Horizon Activities Center, 26272 Butternut Ridge Road. <br />Proposal to erect a pavilion. <br />Heard by Architectural Board of Reuiew January 16, 1991. <br />rlr. D. Smi.th; representing I-iorizons Activity Center, presented revised plans <br />including a separate sketch of the new playgrouid and the additional nature <br />trail that will be addeci within the next two years, and explained that the <br />playground will be completed this year tmder a block grant. He clarified that <br />the nature trails were asphalt, but that the walk to the pavilion would be <br />concrete. Assistant Law Director Dubelko stated that the Law Director advised <br />that the lessee of City property could benefit from the Zoning Code exemptions <br />which the City would normally have depending on the terms of the lease which <br />he has not seen. Mr. Smith will submit a copy of the lease. He further <br />advised that he was not presenting a proposal for a sign at this time since <br />the funds are not available to erect one. Since the revised plans were just <br />presented this evening, the Building Commi.ssioner has not ha.d a chance to <br />review the parking, but he had advised the clerk that he would review and <br />forward his recommendations directly to the B.Z.D. Committee. rir. Smith <br />advised that the forester has reviewed the site, and marked the trees that <br />would have to be removed and those that might present some danger. He <br />2
